In. th- exccut.ion of on.- ^as-:-- z-v nt grant ; P iow,tii.rsfov,,nAs indizr.turcf witn-t3snth that in. can.s:td~r t,i~1 i of the premises, and for the consideration of One Dollar in, hand paid by the said party of the second part td the said parties of the first part, the receipt whereof is hereby acknow- ledged by the said parties of the first part, and for and in consideration of the reservations, covenants and agreements here- inafter contained, the said parties of'the first part do here- by grant, convey and quitclaim to the said party of the second part a perpetual right and easement to construct, maintain, keep in repair, enlarge and reconstruct sewer pipe lines for a comprehensive municipal combined sanitary and storm sewerage system, over, under and across that certain tract or parcel of land situate in the City of Auburn, in the County of King, in the State of Washington; particularly bounded and described as follows, to-wit: Beginning at the intersection of the center line of Main Street East with the center line of "H"' Street S. E., running thence easterly along the center line of said Main Street East a distance of,Fifteen (15) feet; thence northerly on a line parrallel with the center line of "J" Street Lt.. E. to-.its intersection with the south marginal line of'4th street 14. E. produced westerly; thence easterly along said south marginal line &f 4th street I3,. Be produced westerly to its intersection with the west marginal line of J Street N. Be; thence northerly along said west mar inal line of "J" Street id. Be a distance of Thirty (30 feet to the center line of 4th Street V. E. pro- duced westerly; thence westerly along said center line of 4th Street N. Be produced westerly to a point Fifteen (15) feet westerly of the center line of Street )w.•. E. produced northerly on a line parallel with the center line of "J" Street iI. E.; thence.southerly on a line parallel with the center line of "J" Street N. E. to its intersection with the center line of Main Street-East-; thence easterly a distance of Fifteen (15~ feet to place and point of beginning; and do hereby consent that the said party of the second part may level, *ake cuts and fill ins, grade and re-grade said above described strip of land, Thirty (30~ feet in width. And for the consideration aforesaid; each of the parties of the first part herein, does hereby covenant and agree for and on behalf of himself, his and her heira9 executors and assigns, not to build or to construct any buildings or structures -2- 1 upon the thirty (30) foot strip of land hereinbefore particularly bounded and described-o- ' Ry the acceptance of this indenture of easement, the said party of the second part.hereby covenants and agrees to aid with the said parties of the first part their heirs, executors ` administrators and assigns, as follows: the fee title to said strip of land shall remain in the parties of the first part herein, and in their heirs, executors, administrators and assigns, who shall have the right y, !farm and use the space of said strip of land, sub- to conve' ject only to the easement grants hereinbefore contained. I I ` That in case the party of the second part herein, in the exercise of the easement grants herein contained, shall damage.or destroy any crop or crops then growing upon the strip of land above particularly bounded and described, then, and in that case, the party of the second part will promptly pay to the owner of the fee of the land upon which such crops shall be destroyed, or damaged, the fair and reasonable value and compensation for such crops so destroyed or damaged. III That in the exercise and enjoyment of the easement grant herein contained, the party of the second part will build, construct and at.all.times maintain suitable gates or bars where fences now exist, and will keep said fences or bars closed, ex- cept when its officers, employees, contractors, sub-contractors and servants shall have occasion to pass through them, and that the enclosures of the respective lands of the parties of the first part herein may be properly maintained and preserved.
