THIS AGREEMENT made this day of 1988 by and between
the City of Auburn, a municipal corporation of King County, Washington,
hereinafter termed "Grantee" and
Vander Pol Enterprises, Etal Revocable Trust. Inter Vivos and
"Grantor.
WITNESSETH:

That the said Grantor for valuable consideration does by these presents
grant unto the Grantee a perpetual right-of-way or easement for sanitary sewer
with the necessary appurtenances through, over and across the following
described property situated in King County, Washington.
A 20 FOOT WIDE SANITARY SEWER EASEMENT OVER THAT PORTION OF PARCEL 4 OF CITY
OF AUBURN SHORT PLAT NO. 7-87, RECORDED UNDER RECORDING NO. 8808010138,
RECORDS OF KING COUNTY, WASHINGTON, BEING 10 FEET ON EACH SIDE OF THE
FOLLOWING DESCRIBED CENTERLINE:
r- COMMENCING AT THE SOUTHWEST CORNER OF SAID PARCEL 4; THENCE NORTH 85°49'30"
WEST 207.77 FEET; THENCE NORTH 1°46'19" WEST 41.66 FEET; THENCE SOUTH
0 84°08'03" WEST 76.31 FEET TO THE TRUE POINT OF BEGINNING; THENCE NORTH
M. 0°42'38" EAST 122.00 FEET TO THE END OF THIS EASEMENT.

CD That said Grantee shall have the right without prior institution of any
Cn suit or proceeding at law, at times as may be necessary, to enter upon said
property for the purpose of constructing, repairing, altering, or
reconstructing said facility, or making any connections therewith, without
incurring any legal obligation or liability therefore; provided that such
constructing, repairing, altering or reconstructing of said facility shall be
accomplished in such a manner that the private improvements, existing in this
right-of-way shall not be disturbed or destroyed, or in the event that they
are disturbed or destroyed, they will be replaced in as good a condition as
they were immediately before the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of said easement,
so long as said use does not interfere with the installation and maintenance
of the facility and so long as no permanent buildings or structures are
erected on said easement. Large trees which may interfere with future
maintenance or repair of the line shall not be planted within the easement.
