HomeMy WebLinkAbout8707131098 WATER EASEMENT 071387~r Page 1 of 2 E-ifrJJL 10 1a, 1 E A S E M E N T HCORI,s s~crlorl EUCTIONS TH INSTRUMENT made this day of 1987, by Schuck's Auto Supply, Inc, a Washington Corporation, herein CC called the "GRANTOR", and the City of Auburn Washington, herein called the "GRANTEE", ('7 WITNESSETH: That said GRANTOR does hereby convey and confirm unto the said GRANTEE, right-of-way or easement for water mains with " necessary appurtenances over, through, across and upon the 00 following described property in King County, Washington, more particularly described as follows: That portion.of the N. 1/2 of the N.E. 1/4 of the N.E. 1/4 of Sec. 11, Township 21 N., R. 4-E, EWM, in King County, WA. except the Easterly 435.68' of said N.E. 1/4 of the N.E. 1/4 of said Sec. 11 and except that portion lying Southerly of the following described line: Beginning at a point on the E. line of said N.E. 1/4 of the N.E. 1/4 of said Sec. 11, 660' N. of the S.E. corner; thence N.880 49' 17" W. a distance of 1,300.05' to a point on the W. line of said Subdivision 683.87' N. of the S.W. corner of said N.E. 1/4 of the N.E. 1/4 of said Sec. 11. Described as follows: The South 15 feet of the East 535.00 feet of said Lot 2; Also, a 15.00 foot wide strip being 7.5 feet on each side of a centerline described as follows: Beginning at the S.E. corner of said Lot 2; thence North X380-4g'-17" West 530.00 feet; to the true point of beginning of saia centerline; thence North 10-10'-431" East 635.00 feet to a point on the North line of said Lot 2 and 530.00 feet West of the N.F.corner of said Lot 2 and terminus of said centerline. And also granting to the GRANTEE and to those acting under said GRANTEE the use of such additional area immediately adjacent to said easement as shall be required for the construction and main- tenance of the water main and appurtenances in the above described easement; such additional area to be held to a minimum and returned to its original state by the GRANTEE or its agents. 87-,-'07---'13 #1098 A RECD F 6.00 CASHSL t-1 RECORD AND RETURN TO: City of Auburn " Legal Department 25 West Main Street Auburn, WA 98001 i Page 2 of 2 That said GRANTEE shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering therewith, without incurring any legal obligation or liability therefor; provided that such constructing, repairing, altering or reconstructing of said water main shall be accomplished in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the GRANTEE. The GRANTOR shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the water main and so long as CO) ,rA no permanent buildings or structures are erected on said ease- ment. . This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both ~J parties hereon.
