For and in consideration of the premises and other good and valuable consideration, receipt of
which is hereby acknowledged, and for benefits to be derived by the Grantors herein, Grantor,
Larry W. Muhlhauser and Kathryn Muhlhauser, husband and wife, hereby convey and
warrant to the City of Auburn, Grantee herein, a municipal corporation of King County,
Washington, its successors and assigns, a perpetual Nonexclusive Below Grade Easement (with
the exception of associated manholes which it is understood will be at the ground surface) beneath
the following described real property for the purpose of laying, maintaining, and installing a
sanitary sewer main, said real property being described as follows:
SEE EXHIBIT "A" ATTACHED HERETO AND BY THIS REFERENCE MADE A
PART HEREOF.
This easement is given for the purpose of allowing a below grade sanitary sewer main, as outlined
above, and access thereto, across the real property described in attached Exhibit "A" and for no

Said Grantee shall have the absolute right, at times as may be necessary, for immediate entry
upon said Easement for the purpose of maintenance, inspection, construction, repair or
reconstruction of the above improvements without incurring any legal obligation or liability
therefore.
Typical vehicular access to said easement for the above described purposes is also hereby granted
over the existing driveways within the grantor's property. Such additional access shall be utilized
to minimize damage as may occur during activities outlined above.
Grantee shall restore to original condition or better any damages resulting from maintenance,
inspection, construction, repair or reconstruction of the sewer main. As such:
A. All driveway areas cut during maintenance, inspection, construction, repair or
reconstruction, shall be resurfaced with asphalt and new curb to match the existing curb;
B. All grass areas disturbed during maintenance, inspection, construction, repair or
reconstruction, shall be replaced with new sod; and
C: All trees or shrubs shall be replaced if damaged or moved during maintenance,
inspection, construction, repair or reconstruction.

Said Grantor shall not in any way block, restrict or impede ingress to and/or egress from said
Easement, and/or in any way block, restrict or impede full use of the real property within the
C=) herein described easement, by said Grantee, for the above described purposes. This Easement

r-, shall not limit the Grantor's right to build movable structures such as a gazebo, dog house, garden
shed, water feature, or other structures across the Easement property. No permanent structures
C~j with foundations shall be built across said Easement. Said Grantor may fence across said
Lr) c) Easement and/or along the boundaries of said Easement provided that a gate is constructed in said
fence. Said gate shall be of sufficient length and location to allow the Grantee full use of and
ingress to and/or egress from the real property within the above-described Easement. If said gate
rIJ is to be locked, keys shall be provided to the Grantee.

This Easement shall be a covenant running with the above-described real property and burden said
real estate, and shall be binding on the successors, heirs and assigns of all parties hereto.
