A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON; AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE
CITY OF AUBURN AND THE LOWEST RESPONSIBLE BIDDER
FOR PUBLIC WORKS CONTRACT NUMBER 09-04; PROJECT
NUMBER, CP0819, PEASLEY CANYON ROAD CULVERT
- REPLACEMENT
` WHEREAS; the City Council of the City of Auburn has a storm sewer culvert on
Peasley Canyon Road that needs to be replaced to ensure safe passage of the
traveling public and seasonal migration of salmonoids in Mill Creek and also to ensure
preservation of the long term functionality and investment in the roadway and adjacent
properties; and
WHEREAS, a projecf Bid Opening for the construction of the storm sysfem on
Peasley Canyon Road, 300 feet west of West Valley Highway is scheduled to take
place on June 24, 2010; and
WHEREAS, the material procurement period for the pre-cast concrete structure
pieces' (the box culvert, wingwalls, and headwalls) is anticipated to be 6 to 8 weeks;
and
WNEREAS, the construction period for in water work allowed by the permitting
agencies for this project closes on $eptember 30, 2010; and
_ WHEREAS,,the City of Auburn Pubtic Woi-ks Department will assess the bids
received and identify the Lowest Responsible Bidder following the Bid Opening; and

WHEREAS, it is in the public interest.for the parties to enter into an agreement
for construction of CP0819, Peasley Canyon Rd Culvert Replacement, with all
expediency to take advanfage of the remaining construction season.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, KING
COUNTY, WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The Mayor of the City of.Aubum and the Aubum City Clerk are
hereby authorized to review bids, award, and execute an Agreement befinreen the City
of Auburn and the Lowest Responsible Bidder for Project Number CP0819, Public
Works Contract Number 09-04, Peasley Canyon Road Culvert Replacement, which agreement shalf confoRn with the Bid Documents, provided that the bid amount does
not exceed the estimated costs as shown on the budget status sheet, attached hereto
as Exhibit A.
~ Section 2. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of this
legislation.
- Section 3. This resolution shall be in full force and effect upon passage and
signatures hereon.
