1 AN. ORDINANCE of the city of Auburn vacating a portion of
- 2 "B" street southwest, on the petition of the Northern
Pacific Railway C,orapany and others.

WHEREAS, heretofore and on the 24 day of Say ,1922,

there was filed with the city clerk of the city of Auburn, a

municipal corporation within King County, Washington, a petitin
6
signed by the Northern Pacific Railway Company, a Wisconsin
7
corporation, , and others, addressed to the city council of the
8
city of Auburn arid asking for the • vacation of a, portion of
. • "B" street southwest (formerly Railroad street) in the city

of Auburn, King County, Washington, as fully described in said

12 petition and as hereinafter fully described; and
WHEREAS, heretofore and on--the 4h day of -May- ,1922,

at a regular meeting of the city council of the city of Auburn,
15 held on said. date, it was made to appear to the satisfaction

16 • f said city council that the petitioners signing said petition
• 17 ,,,ere the owners of more than two-thirds of the private prop-
18 erty abutting upon the portion of "B" street southwest ( former-
19 ly Railroad street) so sought to be vacated; the city council
20 did then and there by resolution fix and designate Tuesday
. .
. 21 evening, May 30, 1922, •at the hour of 8' o' clock p.m. , at the

• city hall in the city of Auburn, King County, Washington, as
23 the time and place when and where said petition should be
• 24
eard and determined; and

WHEREAS, pursuant to the provisions• of said resolution the
• 26
city clerk of the city of Auburn did thereafter, and on the
27

1 and a like notice in •a oonspiououe place on the portion of
2 said "B" street southwest ,( formerly Railroad street) so sought '
3 to be vacated, which notice was signed by the city clerk of
4 the city of Auburn" and contained a statement, that a petition
5 had beenfiled to vacate the
portion of. said "B" street south-
6 west (formerly Railroad street) within the city of Auburn,

King County, Washington, hereinafter more particularly
8
described, ,and that said petition would be considered and
9 .
determined by the city council 'on the 30th day of May, 1922,
10
at the hour of 8 o' clock p.m, at the city hall in said city

of Auburn, King County; Washington; and

_WHEREAS, .proof by ,affidavit of the posting and setting up

14 of said notice, as aforesaid, is now on file in the office
• 15 of the said city clerk of the city of Auburn, and the said
• 16 notice so given is. found by the city council of the city of
• 17 Auburn to have been ,in form as provided by the statutes of -
18 the State of Washington in such oases provided., and to have
19 been duly posted for the time and in the manner provided
21 by statute; and .

• 3 , "All' that portion of "B" street southwest, a public
4. street within the city of Auburn, King county, Washington
particularly described'as• follows:
5 The westerly twenty-eight and one-half feet, which '
is the west one-half of "B" street southwest ( formerly
6 Railroad street) lying easterly' of and contiguous to the
Northern Pacific Railway Company' s right of way and be-
7 tween the northerly line of Pirst street southwest ( for-
merly Second street) produced westerly and a line sixty
8 feet south of and parallel to the produced northerly
line of First street southwest.

• . duced westerly is also the southerly line of that por-
10 tion of "B" street southwest i°hieh was vacated on •to wit:'
December 23rd,1892, by the King county commissioners."

Section 2. This, ordinance shall take effect and be in
force five days from and after publication after its passage

15 and approval, if approved by the mayor; otherwise it shall
16 take effect at the time it shall become a law under the pro-

visions of the statutes of the state of Washington.
