There is no presumption of validity for a Rezone and the applicant has the burden of proof in establishing compliance with all of the following criteria: ACC 18.64.040(A) The rezone implements the policies of the comprehensive plan; or Per the Comprehensive Plan Land Use Map (Map 1.1, page LU-29, Volume 1, Auburn Comprehensive Plan), and current eGIS land use maps, the parcel is designated for Institutional use. By changing the parcel from R-5 zone to Institutional zone, the policies and vision of the comprehensive plan are consistent with this proposal. ACC 18.64.040(B) The rezone is necessary due to a substantial change in circumstances since the current zoning; and The parcel is currently zoned R-5, which permitted the use of the site as a daycare facility. Operations of the daycare center have since ceased and Green River College cannot use the parcel for Institutional functions as college/university/public uses are not allowed in the R-5 zone. Rezoning the parcel is necessary to allow the College and the State to make the best use of existing resources. By designating the parcel as Institutional zone, the College can have the opportunity to make the most use of their property. ACC 18.64.040(B) The rezone bears a substantial relationship to the public health, safety, or welfare. The rezone does not bear a substantial relationship to public health, safety, or welfare.
