SERVICE ENVIRONMENT ECONOMY CHARACTER SUSTAINABILITY WELLNESS CELEBRATION REZ22-0001 GREEN RIVER COLLEGE PROCEDURAL CONSIDERATIONS In accordance with ACC 14.07.030 and .040 Application deemed complete on December 9 ,2022 Notice of Application (NOA)and Notice of Public Hearing (NOPH) issued December 23,2022 Notices posted: at site mailed to adjacent property owners within 300 feet published in the Seattle Times R e -notice sent to adjoining property owners with clarification of address of subject site. SERVICE ENVIRONMENT ECONOMY CHARACTER SUSTAINABILITY WELLNESS CELEBRATION REZ22-0001 GREEN RIVER COLLEGE PROCEDURAL CONSIDERATIONS In accordance with ACC 14.03.001 Project permit decisions are classified into four types,based on whether a director,the hearing examiner or the city council makes the decision and the process by which that decision is made. In accordance with ACC 14.03.040 Site-specific Rezone Category 1 ,consistent with the comprehensive plan land use map are processed as a Type IV decision. Type IV decisions are quasi-judicial decisions made by the city council following a recommendation by the hearing examiner. SERVICE ENVIRONMENT ECONOMY CHARACTER SUSTAINABILITY WELLNESS CELEBRATION REZ22-0001 GREEN RIVER COLLEGE REZONE APPROVAL CRITERIA ACC 18.68.040 –There is no presumption of validity for a rezone (zoning map amendment) and the applicant has the burden of proof in establishing compliance with all of the following criteria: The rezone implements the policies of the comprehensive plan; or Staff Analysis –the Comprehensive Plan designation of the site is “Institutional” and the zoning district of “Institutional” implements this Comprehensive Plan designation. SERVICE ENVIRONMENT ECONOMY CHARACTER SUSTAINABILITY WELLNESS CELEBRATION REZ22-0001 GREEN RIVER COLLEGE REZONE APPROVAL CRITERIA The rezone is necessary due to a substantial change in circumstances since the current zoning; and Staff Analysis –Green River College has determined there is a greater resource that can be made of the existing building which requires a change of zoning to allow and permit that use (staff offices and teaching & learning center for instructors) The rezone bears a substantial relationship to the public health, safety, or welfare. Staff Analysis –The rezone should not have an adverse impact on the surrounding area. Existing Map Proposed Map SERVICE ENVIRONMENT ECONOMY CHARACTER SUSTAINABILITY WELLNESS CELEBRATION REZ22-0001 GREEN RIVER COLLEGE STAFF RECOMMENDATION Based upon the application,accompanying materials,Findings of Fact,and Conclusions of this Staff Report,Staff recommends that the Hearing Examiner recommend approval of rezoning the property from R -5 ,Residential to I,Institutional to the City Council.
