AN ORDINANCE: :Providm~ for the improvement o,f all that .'
portion of Fourth street N. E. situate between Auburn Avenue and~
the easterly boundar;y' line of .Lange r s First AdditiOn to Auburn,
and all that portion of Third Street H.E. situate between Auburn
Avenue and D street N. E.', all in the Ui ty' of Auburn, b;y the greding,
paving and curbing of said portions of Fourth street N. ~. ":'and
Third ~treet N. E., and the doing of suc~ other work as shall be
necessa17, all according to the plans and specifications on file
with the City Clerk and in accordance with .the resolution of intention
providing for Local Improvement District ~o. 76; approving and ~dopt-
ing said plans Gnd specifications; crecting Local District No. 76
and Local Improvement Fund, District 1~0. 76; provicli ng for the assess-
ment of the cost and expense of such improvement upon the property
in said district; and provicli ng for the payment thereof by bonds of
said district.
r.rhe City" Council of the City of Auburn do ordain as follows:
Section .1. rl'hat all that po rt ion of Fourth street JlT. E. situate
between Auburn Avenue and the easterly boundary line of Lange'S
First Addition to Auburn, and all that ~~rtion of Third Street N. E~
situate between Auburn Avenue and D Street N. E., all in the City of
Auburn, be improved by grading, paving and 9urbing said portions of

all according to the plans and specifications for said improvement
prepared bYJthe City Engineer and now on file in the office of the
C it>v~~ Clerk, and in accordance with tl-}e resolut ion 0 f intention
provlding for ~ocal Improvement District ~o. 76 passed by tne City
Council on April 8, 1924.
Section 2. ~hat the plans and specifications for said improve-
-ment prepared ~y the City Engineer and now on file in the office of
the City Clerk be, and the same hereby are, approved and adopted.
Section 3. That the cost and expense of said improvement, in-
cluding all necessary and incidental expenses, shall be borne by and
assessed against the property included in the assessment district
hereinafter created accordinR' to law. The Citv of Auburn shall not

be ,liable i11 any marmer for any pOl-tioTI of the cost and expense of said
im:.)rovement except as here in provided.
Section 4. 'i.'hat there is here1):'," established a Local Improveflent
__ District t8 be called Local Improvement ~istrict r~o. 76, which said
District is described as follows:
"All of the property betiveen the termini of t:hose ")ortions
of said streets proposed to be i~proved as aforesaid and on
each side thereof, abutting upon, adjacent, vicinal or proximate
to such portions of said streets to a distance back from the
marginal lines thereof as provided by law."
Section 5. 'l'hat saiCl. impro vement shall be made by the City of
Auburn under the supervision of the City Council thereof or such
committee or persons as the City Council ma~l designate.
Section 6. That there is herel)y established in the Treasury
of the City" of Auburn a fund to be lrnown as "Local ImproveL:1ent Fund,
District Ho. '78'; that all money paid into the treasury' of the City of

Auburn on account of the cost an d erpense of improvements in said
District shall be paid into and credited~to said fund, and that all
wa:;rants drawn or issued lJY the Uity of Auburn in payment for improve-
ments in or e~~enses against said district shall be drawn upon and pay-
able from said fund.

Section 7. PS;yIlent for said improvement shall be made in the
~irst instance by waTrants drawn upon said Local Im:prov,ement b'und,
which warrants shall bear interest pt the rate of eight per cent
per annum. Bonds bearing interest at the rate of seven per cent per
annum payable on or before twelve years from the date of issuance
shall be issued in payment of the co st anct _expense of said improvement,
which bonds shall be redeemed ~y the collection of sp~cial assess-
ments to be leviea and assess~d upon the property within said district,
lByable in ten equFl annual installments, with interest at the rate of
seven per cent per annum, under tJ-e mode of fTPayment lJY BondsfT as
defined by law.
Sect ion 8. Tl~e City' Treasurer shall, UpOD rece ipt of an assess-
ment roll therefor, publish a'notice in the official newspaper of the
City of Auburn for two consecutive weekl;y" issues that such- roll is
in his hands for col}ect ion and that .any assessment thereon or an '.]
portion of any aSi;lessment may be paid at an~l time within thirty days
from the dateAc~ ~he first publication of said notice, without interest,
penalty' or cost, and tlIat unless payment be made within such tjme the
sum remaining unpaid thereafter may be paid in equal annual install-
ments, the number of which annual installments shell be two less t1an
the number of years which said bones are to run, with interest on the
whole unpaid sum so charged at the ;rate of seven per cent per annum,
payable annually, and each year ~hereafter one of such installmen ts, to-
gether with the interest due thereon and on all installments thereafter
to become due shall be collected in the PJe..l1ner provided by law, and un-

Section 9. Fl1rthel1 provision shall be made by the C it Y Council for
