E. situate between D Street S. E. and F Street S. E., all in the City of Auburn by the construction of a concrete and ce- ment sidewalk five (5) feet in width on the northerly side of said portion of 9th street S. E. and the doing of such other work as may be necessary, all according to the plans and specifications on file with the City ~lerk and in accordance with the resolution of inten- tion providing for Local Improvement District No. 88; approving and adopting said plans and specifications; creating Local Improvement District No. 88; providing for the assessment of the cost and expense of such i~provement upon the property of said district; and pro- viding for the payment thereof by bonds of said district. The City Council of the City of Auburn do ordain as follows: Section 1. That all that portion of 9th street S. E. in the City of Auburn, situate between D Street S. E. and F Street S. E., be im- proved by the construction of a concrete and cement sidewalk five (5) feet in width on the northerly side of said portion of 9th Street, S. E., and the doing of such other work as shall be necessary to properly complete said improvement; all acoording to the plans and specifioations for said improvement prepared by the City Engineer and now on file in the office of the City Clerk, and in accordance with the resolution of intention providing for Local Improvement District No. 88 passed by the City Council on March 17, 1925. Section 2. That the plans and specifications for said improve- ment prepared by the City Engineer and now on file in the office of the City Clerk be, and the same hereby are approved and adopted. Section 3. That the cost and expense of said improvement, in- cluding all necessary and incidental expenses, shall be borne by and assessed against the property included in the district hereinafter created according to law; and that all of such cost and expense shall be borne by and assessed against the property situate on the northerly side of said portion of 9th street S. E. Section 4. That there is hereby established a Local Improvement District to be called Local Improvement District No. 88, which said district is described as follows: "All of the property between the termini of that portion of said street proposed to be improved as aforesaid, and on the northerly side thereof, a,;ut"c ing upon, adjacent, vicinal, or proximate to such portion of said street to a distance back from the mar9,inal line thereof as pro- vided by law." Section 5. That said improveElent shall be made by the City of Auburn under the supervision of the Uity Council thereof or such committee or persons as the City Uouncil may designate. Section 6. fhat there is hereby established in the treasury of the City of Auburn a fund to be known as "Local Improvement Fund, District l~o. 88lt; that all moneys paid into the treit1.sry of the City of Auburn on account of the cost and expense of improvements in said district shall be paid into and credited to said fund, and that all warrants drawn or issued by the Uity of Auburn in payment for improvements in or expenses against said district shall be drawn ~l- " ... ~~ . >> . ~ e--_A .. ~.- /' .- ~' upon and payable from said fund. Section 7. Payment for said improvement shall be made in the first instance by warrants drawn on said local improvement fund, which warrants shall bear interest at the rate of eight per cent. per annum. Bonds bearing interest at the rate of seven per cent. per annum payable on or before seven years from the date of is- suance shall be issued in payment of cost and ~xpense of said im- provement, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in five equal annual installments, with interest at the rate of seven per cent. per al1l11Uil, l,mder tbe mode of payment by bonds as defined by law. trr- ' Seotion 8. The City Treasury sball, upon receipt of an assess- ment roll therefor, publish a notice in the official newspaper of the City of Auburn for two consecutive weekly issueBn.:t.hat such roll is in his hands for collection and that ana tha~ ~~-assessment thereon or any portion of any assessment ~8rQQB may^be paid at any time within 30 days from the date of the first publication of said notice, without interest, penalty or cost, and that unless payment be made within such time the sum remaining unpaid thereafter may be paid in equal annual installments, the number of which install- ments shall be two less than the nrunber of years said bonds are to run, with interest on the whole unpaid sum so charged at the rate of seven per oent. per annum, payable annually, and eaoh year there- after one of such installments, together with interest due thereon and on all installments thereafter to bEcome due shall be collected in the manner provided by law, and unless payment be made at the time, such installment or installments shall bear interest at the rate of seven per cent. per annum and may be collected and the lien thereof enforced in the manner provided by law. Section 9. Further provision shall be made by the City Council for the levy and collection of the assessments herein provided for and for the issuance of said bonds in payment of the cost and ex- pense of said improvement, such provision to be made from time to time by ordinance. Section 10. :J}his o,cdinance shall take effect and be in force five days from and after its passage, approval and publication as required by law.
