FOR TIlE VACATION OF A PORTION OF .', CERT:.IN STREET IN THE CITY OF

WHERE¡\S, the Cit.y Council of the City of ,'mburn has passed and
adopted Resolution Number --1LQ_ resolving that a public hearin,,!; shall
be held upon the premises of Joseph Edward Klontz and Lucille Rachel
Klontz, his wife, for the purpose of deterr1ining whether or not a por-
tion of a certain street in the City of Auburn should not be vacated,
said portion being described as follows:
Th~t portion of the culdesac lying north of the north line
of 21st Street, Northeast, (South 308th Street) extended
Westerly to the East marginal line of Primary Stat<' IH~(hway
No.5, located in Joseph E. Klontz Second Addition, Vol. 54-
100, Section 7, Township 21, Range 5.
and,
WHEREAS, said Joseph Edward Klontz and Lucille Rachel Klontz, his
wife, the petitioners herein, own all of t.he property abutting the por-
tion of the City Street which they desire; and,
WHEREAS, notice of public hearing to vacate said street, was given
by the City Clerk of the City of Auburn, said City Clerk posting three
(3) copies of said notice in three (3) public places in the City of
Auburn, and a copy of said notice on that street to be vacated, giving
notice that the hearing on said petition was to be held on the 5th day
of December, 1961, at 8:00 P.M. in the City Hall of the City of Auburn, and
WHEREAS, said public hearing was duly called and had on the 5th day
of December, 1961, at 8:00 P.M. in the City Hall or the City of Auburn,
NOW, THEREFORE, THE CITY COUNCIL OF TIlE CITY OF AUBURN DO ORDAIN AS
FOLLOWS:
Section 1. That a portion of a certain street in the City of Auburn,
described as:
That portion of the cuIdesac lying north of the north line of
22nd Street, Northeast, (South 308th Street) extended westerly
to the east marginal line of Primary State Highway No.5, lo-
cated in Joseph E. Klontz S"'cond ~-\ddition, Vol. 54-100, Section
7, Township 21, Range 5,
be and the same is hereby vacated, and the property lying in said street
shall be returned and belong to the abutting property owners with an
easement reserved thereon to the City of Auburn for utilities.

Section 2. This ordinance shall take effect five (5) days from
and after its passage, approval and publication as provided by ] aw.
