E., in the City of Auburn, County of King, Washington, <br />situate between Main street East and Fourth street N. E. in said city, <br />and providing that the title to all of the vacated areas shall vest <br />in the owners of the abutting property. <br /> <br />WHEREAS, heretofore, to-wit: On or~ the 5th day of <br />March, 1929, H. H. A. Hastings, et aI, caused to be filed with the <br />City Clerk of the City of Auburn~r petition in writing, addressed <br />to the Mayor and the City Council of the City of Auburn, praying that <br />all those nortions of M Street N. E. situate between Main Street East <br />and Fourth~Street N. E. in the City of Auburn, which portions are here- <br />inafter particularly bounded and described, be vacated, and that the <br />title to all of such areas s~oposed to be vacated be awarded and <br />made to vest in the owners of,., ~ abutting property; and \.' . <br /> <br />WP..EREAS, heretofore, to-wi t: On the 5th day of March, 1929, <br />at a regular meeting of the Oity Council of the City of Auburn her~:on <br />said day, it was made to appear to the satisfaction of said Oity Oc)>' <br />that said oetitioners were the owners of more than two-thirds of th <br />private property abutting upon that portion of M Street N. E. in the <br />Oity of Auburn situate between Main Street East and Fourth Street N. E. <br />in said city, and said Oity Council did tnen and there, by resolution, <br />fix and designate Tuesday evening, April 2, 1929, at 8 olclock P.M., <br />at the City Hall in the Oity of Auburn, King County, Washington, as <br />the time and place when and where said petition would be heard and <br />determined by said City Council; and <br /> <br />WHEREAS, pursuant to the provisions of said resolution the <br />Oity Clerk of the City of Auburn did thereafter and on the 7th day ,of <br />March, 1929, and more than twenty (20) days prior to the day fixed for ~,/f <br />such hearing as aforesaid duly give twenty days notice of the pendenc~ <br />of said petition by a typewritten notice set up in three of the most.. <br />public places in the Oity of Auburn and by a like typewritten notice <br />set up in a conspicuous place on the portion of said M Street N. E., <br />situate betweBn Main Street East and Fourth Street N. E. so sought to <br />be vacated, which typewritten notice was signed by the City Clerk <br />of the City of Auburn and contained a statement that a petition had been <br />filed to vacate the two uarticular Dortions of M Street N. E. in the <br />Ci ty of Auburn hereinafter particula.rly described, that said peti tion <br />was pending, and that April 2,1929, at 8 o'clock P.M., at the Oity Hall <br />in the City of Auburn, King Oounty, Washington, had been fixed and <br />determined as th~ time and place for the hearing of said petition; and <br /> <br />WHEREAS, due proof by affidavit of the posting and setting up <br />of said notices as aforesaid is now on file in the office of the Oity <br />Olerk of the Oity of Auburn; and <br /> <br />-"'lII <br /> <br />'"" <br /> <br /> <br /> <br />4 <br /> <br />WHEREAS, said petition came on regularly to be heard by said <br />City Oouncil on said April 2, 1929, at 8 o'clock P.M., at the City Hall <br />in the Oity of Auburn, King Oounty, Washington (that being the time and <br />place fixed for said hearing), and no written objections to the granting <br />1 of said petition hav~ been submitted to the Oity Councilor filed with <br />the Oity Olerk; and <br /> <br />.~ W~tInCl()J I It has been made to appear to thesatie~a91tDr~~.:ej'" <br />Oountil of the Oity of Auburn that the two por~i~~'bf M street N.
