E., in the City of Auburn, County of King, Washington, situate between Main street East and Fourth street N. E. in said city, and providing that the title to all of the vacated areas shall vest in the owners of the abutting property. WHEREAS, heretofore, to-wit: On or~ the 5th day of March, 1929, H. H. A. Hastings, et aI, caused to be filed with the City Clerk of the City of Auburn~r petition in writing, addressed to the Mayor and the City Council of the City of Auburn, praying that all those nortions of M Street N. E. situate between Main Street East and Fourth~Street N. E. in the City of Auburn, which portions are here- inafter particularly bounded and described, be vacated, and that the title to all of such areas s~oposed to be vacated be awarded and made to vest in the owners of,., ~ abutting property; and \.' . WP..EREAS, heretofore, to-wi t: On the 5th day of March, 1929, at a regular meeting of the Oity Council of the City of Auburn her~:on said day, it was made to appear to the satisfaction of said Oity Oc)>' that said oetitioners were the owners of more than two-thirds of th private property abutting upon that portion of M Street N. E. in the Oity of Auburn situate between Main Street East and Fourth Street N. E. in said city, and said Oity Council did tnen and there, by resolution, fix and designate Tuesday evening, April 2, 1929, at 8 olclock P.M., at the City Hall in the Oity of Auburn, King County, Washington, as the time and place when and where said petition would be heard and determined by said City Council; and WHEREAS, pursuant to the provisions of said resolution the Oity Clerk of the City of Auburn did thereafter and on the 7th day ,of March, 1929, and more than twenty (20) days prior to the day fixed for ~,/f such hearing as aforesaid duly give twenty days notice of the pendenc~ of said petition by a typewritten notice set up in three of the most.. public places in the Oity of Auburn and by a like typewritten notice set up in a conspicuous place on the portion of said M Street N. E., situate betweBn Main Street East and Fourth Street N. E. so sought to be vacated, which typewritten notice was signed by the City Clerk of the City of Auburn and contained a statement that a petition had been filed to vacate the two uarticular Dortions of M Street N. E. in the Ci ty of Auburn hereinafter particula.rly described, that said peti tion was pending, and that April 2,1929, at 8 o'clock P.M., at the Oity Hall in the City of Auburn, King Oounty, Washington, had been fixed and determined as th~ time and place for the hearing of said petition; and WHEREAS, due proof by affidavit of the posting and setting up of said notices as aforesaid is now on file in the office of the Oity Olerk of the Oity of Auburn; and -"'lII '"" 4 WHEREAS, said petition came on regularly to be heard by said City Oouncil on said April 2, 1929, at 8 o'clock P.M., at the City Hall in the Oity of Auburn, King Oounty, Washington (that being the time and place fixed for said hearing), and no written objections to the granting 1 of said petition hav~ been submitted to the Oity Councilor filed with the Oity Olerk; and .~ W~tInCl()J I It has been made to appear to thesatie~a91tDr~~.:ej'" Oountil of the Oity of Auburn that the two por~i~~'bf M street N. E. in the City of Auburn so sought to be vac~ted are now of no use to the Oi ty of Auburn or to the public for street purposes "C 'Oy reason of the fact, that the original boundary lines of that portion of M Street N.E. as now improved have been changed; and .~ , '. ~ -.--.. WHEREAS, the City Oouncil of the Oity of Auburn, being fully advised of the facts e~d the law in the premises, ordered the preparation of this ordinance; NOW, THEREFORE, THE CITY OOUNCIL OF THE CITY OF AUBURN DO ORDAIN AS FOLLOWS: Section 1. That the two following described tracts of land situate in that part of M Street N. E. in the City of Auburn lying between Main Street East and Fourth street N. E. in said City and adja- cent to M Street N. E. as now improved, to-wit: Be~inning at the southwest corner of Lot One (1) in Block One (1) of Ewing & Ryan's First Addition to Auburn, King County, Washington, running thence north 30 08' east along the west line of said Lot One 43.33 feet, thence south 70 141 west 43.55 feet, more or less, to the north line of Second Street N.E. in said City of Auburn, thence east 3.09 feet, more or less, to point of beginning; containing .0007 acres, more or less; Also conrr~encing at the southwest corner of Lot One (I) in Block o of Witt's First Addition to Auburn, King County, Washington, running thence west along the north line of Main Street East 55.00 feet, thence north 30 08' east along the west line of M Street N. E. and narallel with the west line of said Witt's First Addition a distance of 699.33 feet to the true uoint of beginning; running thence continuing north 30 08' east 420.63 feet, more or less, to the south line of Fourth street N.E. in the Oity of Auburn, thence east along the south line of Fourth Street N~E. 30.32 feet, thence south 70 14' west 420.66 feet, more or less, to the true point of beginning; containing 1.46 acres, more or less; all si tuated and being in the Oounty of King, state of Washington; be., and the same hereby are vacated, and that the portions of said M strep. N. E. so vacated shall be attached to the private property abutting thereon as provided by law. Section 2. That this ordinance shall take effect and be in force five days from and after its passage, approval and publication as required by law. Introduced April 2, 1929 Passed Ap!'il 2, 1929 1929 ..
