Home My WebLink About1913 ORD I NANCE ~O. 19/3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATlW; TO AND PROVIDING FOR THE ANNEX- ATION TO THE CITY OF AUBURN A CONTIGUOUS AREA OF LAND LYING ADJACENT TO THE WEST- ERLY IM.RGINAL LINE OF THE EXISTING CITY LIMITS OF THE rlTY OF AUBURN, WHICH LAND IS DESCRIBED IN A PETITION DULY FILED WITH THE CITY COUNCIL OF THE CITY OF AUBURN, AND REPEALING ORDINANCE NO. 1877. WHEREAS, the City Counc i I of thp City of Aubu~n w~s not i f i ed by owne~s of p~opedy having mo~e than ten pe~ cent in value of the assessed valuation within the p~oposed a~ea to be annexed, that they desi~ed to ci~culate a petition to commence arnexation p~oceed- ings to the Ci ty of Aubu~n; and, WHEREAS, the City Counci I of the City of Auburn subsequently authorized the circu- lation of the petition within the proposed area to be annexed; and, WHEREAS, the petition for annexation of the property he~einafte~ described waS duly fi led with the City Counci I of the City of Auburn on the 21st day of February, 1966, which petition waS signed by the owners of more than 75% in value of all of the property lying within the limits of the proposed area to be annexed according to the assessed valuation for general taxation of the property for which an annexation is petitioned, said petition setting forth the legal description of the p~opert y to be annexed and tlei ng accompanied by a plat out lining the boundaries of said area sought to be annexêd¡ and, WHEREAS, the CI ty Counci I of the Ci ty of Aubu~n fixed a date for pUb'ic hearing to be held at 8:00 p.m. in the City Hall of the City of Auburn on March 21, 1966, setting forth notice of said public hea~ing for annexation to be published in the official City newspaper of the City of Auburn in one issue of sa i d newspape~, and pnw i ding fo~ the posting in three public places within the area proposed for annexation of copies of said notice of public hearing; and, WHEREAS, notice of public hearing of said petition of annexation to the City of Aubu~n has been duly publ ished in the official newspaper of the City of Aubu~n in one regular issue of said newspaper, and the said notice of public hearing having been posted in three public places within the area p~oposed fo~ annexation by the City Cle~k of the City of Auburn, and said public hearing being held at 8:00 p.m. in the City Hal I of the City of Auburn on March 21, 1966, and the City Counci I of the City of Auburn having deter- mined that said annexation is in the best interest and welfare of the City of Aubu~n, did accept and approve the petition above desc~ibed and directed the Mayo~ of the City of Auburn to convene a 80a~d of Review to consider the p~oposed annexation, as ~eqlJi~pd by Section 2, Chapter 282, Laws of the State of Washington, for the yea~ 1961; and, ~~EREAS, on March 31, 1966, at a meeting of the Board of Review convened to consider the annexation, by motion duly made and carried, a ma.io~ity of the 80a~d of Review ap- PaMP nn~ proved the petition for annexation to thp City of Auburn as submitted, and forwarded their findings to the City Counci I of the City of Auburn; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUW:I L OF THE CITY OF AUBURN, WASHING- TON AS FOLLOWS: Section I. That the petition fo~ annexation of the following desc:ribed property hns been duly and properly fi led with the City Counci I of the City of Aubur·n, i'lnd compl ies with al I requi~ements of law, Section 2. That by ~egula~ motion adopted and passed by the City Counci I on the 21~t day of Fehrua~y, 1966, it was ordered that a public hearing be held on said petition for annexation at B:OO p.m. in the City Hall of the City of Auburn on Mnrch ::'1, 1966, providing for the proper notice to be published and posted acco~ding to law. Section 3. ThM proper notice of public hearing was duly puhlish"d in the official newspaper of the City of Auburn on the 9th day of March, 1966, and Wi'lS duly posted in three public places within the area proposed for annexation hereinafter· described, ñnd that a public hearing was held at B:OO p.m. in the City Hall of the Cil·y of Auburn on the 21st day of March, 1966. Section 4. That at the conclusion of the public hearing in the City Hnll of the City of AlJbu~n on the 215t dñy of March, 1966, the City Counci I did approve the petition for annexation and directed the Mayor to convene a Board of Review to consi:der the proposed annexation to the City of Auburn. Section 5. That on March 31, 1966, by motion duly made and carri.¡d, a majority of the Board of Review approved the petition fo~ annexation to the City oli Auburn. Section 6. That the p~operty lying contiguous to the weste~ly mArginal line of the existing city limits of the City of Aubu~n hereinafter desc~ibed be and the same is he~e- by annexed to the City of Aubu~n, said prope~ty being more particula~ly rlesc~ibed as: Beginning at a point on the City of Auburn limits, SJid point being 93.6' west of the northeast corner of the no~thwest qua~te~ of Sec 13, Twp 21 N, R 4 East W. M.; thence west along the north I ine of afo~esaid Section 13, and the no~th line of Section 14, Twp 21 N, R 4 East W. M. to the northwest corner of the no~theast quarter of afo~esaid Section 14; thence north along the east line of tho, south- east quarte~ of the southwest qua~te~ of Section II, Twp 21 N, R 4 East W. M. to the northeast corner of the southeast quarter of the southwest quarte~ of afo~esaid Section I,; thence west along the north I ine of the southeast quarter of the southwest quarter of aforesaid Section I I to the no~thwest co~ne~ of the southeast quarter of the southwest quarte~ of afo~esaid Section I,; thence north along the west I ine of the northeast qua~ter of the southwest quarter .,nd the west line of the southeast quarte~ of the no~thwest quarte~ to the no~thwest co~ne~ of the southeast quarter of the no~thwest qu,,~te~ of aforesaid Section II; thence east along the north line of the south- east quarter of the northwest quarter of aforesaid Section II, to the southwest corner of the northwest quarter of the northeast quarter of of aforesaid Section II; thence north along the west line of the north- west quarter of the northeast qUârter of aforesaid Section I I to the north line of Section II, Twp 21 N, R 4 East W. R/W [City of Auburn Limitsl thence south alg the Puget Sound Power & Light Company RIW to the POB, situate in the County of King, State of Washington. Section 7. That the effective date of the annexation of the above desc~¡bed prop- erty to the City of Auburn shall be the effective date of the passage of this ordinance providing for such annexation. Section 8. That in acco~dance with the terms of the petition fo~ annexation of the above described prope~ty, the area to be annexed shal I assume the indebtedness of the City of Auburn existing at the effective date of the passage of this ordinance. Section 9. That Ordinance No. 1877 of the City of Auburn adopted on Apri I 4, 1966, be and the same is he~eby repealed in its entirety. Section 10. That this ordinance shall take effect five (5) days from and alter its passage, approval and publication, as provided by law.
