HomeMy WebLinkAbout2634ORDINANCE NO;' 2634 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF A PORTION OF STREET RIGHT-OF-WAY SITUATE ON A PORTION OF HOWARD ROAD AT 21ST AND "R" STREETS S;E. WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN; WASHINGTON. WHEREAS, the City Council of the City of Auburn have passed and adopted Resolution No. 513 resolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described right-of-way situate on a portion of Howard Road at 21st Street and "R" Street S.E. within the corporate limits of the City of Auburn shall be vacated, said portion to be vacated being hereinafter legally described in Section 1. of this-.Ordinance; and, WHEREAS, notice of public hearing to vacate the portion of a certain street right- of-way on a portion of Howard Road at 21st and "R" Streets S.E. within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 513 was to be held on the 1st day of MU, 1972 at 8:00 P.M. in the Council Chambers of the City Hall of the City of Auburn, and no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and, WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That ~he followingdescribed portion of a certain street right-of-wu situate on a portion of Howard Road at 21st and "R" Streets S.E. Within the corporate limits of the City of Auburn, more particularly describedas follows: That portion of Howard Road situate in Government Lot #11, Sec 19, Twp 21 N, R 5 E, W;MJ, King County, Washington, the NWly terminus of said portion of Howard Road being the following described line: Beg at theSE corner of said Government Lot #11; th N 00°00'00, E along the Ely boundary of said Government Lot #11; 473.66 ft.; th N 69°35,11'' W, 213.11 ft.; th N 62°11'07, W, 464.22 ft. to a point on the Nly boundary of Howard Road, said point being the TPOB; th Continuing N 62°11'07'' 94.56 ft. to the point of curve of a curve to the rightj said curve havinga radius of 530.00 ft., a radial bearing of N 27~48'53'' E and a central angle of 19°04'27"; th NWly along said curve 176;44 ft; to a point on the SWly boundary of Howard Road, said point being the terminal point of the above described line: The SEly terminus of said portion of Howard Road being the followed described line: Begin at the SEly corner of said Government Lot #11; th N 0¢00'00" E, 113.93 5-5-72 Page One ft.; thenCe N 43°06'40, W, 87.79'ft. to a point on the NElY boundary of Howard Road, said point being the TPOB; th S 00~00'00,' E, 37.43 ft. to the point of curve of a curve to the left, said curve having a radius of 280.00 ft., and a radial bearing N 90000'00,' E; th SEly along said curve to a point located on both the SWlY boUndary of-Howard Road and on the new Wly boUndary of R St. S.E,; said point being the terminal point of the above described line; LESS a strip of land 30 ft. in width, 15 ft. Of which lying on both Sides of the following desCribed centerline: Begin at theSE corner of said Government Lo~ #11; th N 00~00'00" E along the Ely boundary of said Government Lot #11, 163,02 ft.; th S 90°00'00" W, 60.00 ft. to a point on the newWlyboundary of "R, St. S.EJ, said point being the TPOB; th continuing S 90~00'00" W, 25.92 ft. to the point of curve Of a curve to the right; said curve-having a radius of 50.00 ft.,'a radial bearing of N 00~00'00" E and a central angle of 46953'20"; th 40.92 ft. along said curve to the point of tangency, said point of'tangency being 15 ft., measured at right angles, NEly of the SWly boundary of HoWard Road; th N 43906'40" W, parallel to said SWly boundary of HoWard Road, 221.21 ft. to the terminal point of said centerline, situated in the City of Auburn, County of King, State of Washington. Be and the same is hereby vacated, and the property lying in said portion of a certain street r.ight,of-way described hereinabove, shall be returned and belong to the abutting property owner of said portion of a certain street ~ight'of-wa~v situate on a portion of Howard Road at 21st and "R" Streets S.Ej lyi.ng within the corporate limits of the City of Auburn. SeCtiOn 2. That the request for vacation of street right,of-waY be granted subject to a utility easement over, upon and under the entire parcel of land for public Utilities. SeCtiOn 3.
