AN ORDINANCE OF THE CITY OF AUBURN~'WASHINGTON~ RELATING TO AND PROVIDING FOR THE VACATION
OF A PORT ON OF A CERTAIN STREET SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF
AUBURN. '
WHEREAS, the City Council of the City of Auburn have passed and adopted Resolution
No. 329 resolving that a public hearing shall be had for the purpose of determining
whether or not the following described portion of the South side of 40fib Street N.E.
between Auburn Way North and "1" Street N.E. lying within the corporate limits of the
City of Auburn shall be vacatedw said portion to be Vacated being described as follows:
The S 3.7' of the N 1~87.0' of the E 698.64' of H.H. Jones
D.C. No. 39 situated in Section 6-21-5~ County of Klng~
State of Washington.
and,
WHEREASw notice of public hearing to vacate the portion of the South side of 40th
Street~.E. between Auburn Way North and "1" Street N.E. within the corporate limits of
the City of Auburn, in the time and manner provided by law, giving notice that the hearing
on said Resolution was to be held on the 16th day of September~ at 8:00 p.m. in the Council
Chambers of the City Hall of the City of Auburn~ and no objections thereto were filed with
the City Clerk or presented to the City Council at said hearing; and,
WHEREAS~ the City Council, having deemed that the petition for vacation was proper
and that no vested rights would be affected by the same~
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN~ WASHINGTON~ DO ORDAIN AS
FOLLOWS:
Section Ir That the following described portion of the South side of 40th Street N.E.
between Auburn Way North and "1" Street N.E.~ within the corporate limits of the City of
Auburnw more particularly described as follows:
The S 3.7~ of the N 1387.0' of the E 698.64' of H.H. Jones
D.C. No. 39 situated in Sec 6-21-5 Co. of King, St. of Wash.
be and the same is hereby vacafed~ and the property lying in said portion of the street
described hereinsbove, shall be returned end belong to the abutting property owners~
Valley Associates, Oscar C. Sandberg~ Jr., and Albert A. James,
Section, 2. That this ordinance shall take effect five {5] days fr~n and after its
passage, approval and publication as provided by taw.
