ORDINANCE NO. " 2402
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ADOPTING FOR THE CITY OF AUBURN A
CLASSIFICATION OF NON-CHARTER. CODE CITY PURSUANT.TO THE OPTIONAL MUNICIPAL CODE
OF THE STATE-OF WASHINGTON:"
WHEREAS, the Legislature of the State of Washington enacted an optional municipal
code providing an alternative method of government for municipalities in the State of
Washington in the Laws of 1967, Ex. Sess:, Chapter 119, which legislation became
effective July 1, 1969; and,
r` WHEREAS,-?the'City'Council" of^the"City of Auburn by Resolution No. 373 passed
July 21, 1969 declared their intention to adopt for the City of Auburn a classification
of Non-Charter Code City retaining the Council-Mayor plan of government underwhich the
City is presently operating, pursuant to Chapter 35A.02.030 of the Revised Code of
Washington; and,
WHEREAS, said Resolution was duly published in the time and manner provided by law
and more than 90 days has expired from, but excluding the date of first publication of
said Resolution and no timely and sufficient referendum petition has been filed, as
determined by Section 35A.29.170 of the Revised Code of Washington; and,
WHEREAS, the City Council now desires to effect the intent expressed in said
Resolution No. 373 by enacting an Ordinance adopting for the City the classification of
non-charter code city in the manner provided hereinafter;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. There is hereby adopted for the City of Auburn, Washington, the
classification of non-charter code city retaining the council-mayor plan of government
underwhich the City of Auburn is presently operating, as provided in Section 35A.02.030
of the Optional Municipal Code for the State of Washington.
Section 2. That the City Clerk is hereby authorized and directed to forward to the
Secretary of State a certified copy of this Ordinance for filing pursuant to Chapter 35A.
02.040"bf`the Revised Code of Washington.
Section 3. That this Ordinance shall take effect five (5) days from and after its
passage, approval and publication as provided by law.
