AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION
OF A PORTION OF A:CERTAIN ALLEY SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF
AUBURN, RESERVING AN EASEMENT THEREIN TO THE CITY OF AUBURN FOR ALL PUBLIC UTILITIES.
WHEREAS, the City Council of the City of Auburn have passed and adopted Resolution
No. 413 resolving that a public hearing shall be had for the purpose of determining
· whether or not the following described portion of the alley situate between "D" and "E"
Streets N.E., north of 4th Street N.E., lying within the corporate limits of the City
of Auburn shall be vacated, said portion to be vacated being hereinafter legally described
in Section I of this Ordinance; and,
WHEREAS, notice of public hearing to vacate the portion of the alley situate between
"D" and "E" Streets N.E. north of 4th Street N.E., within the corporate limits of the
City of Auburn, in the time and manner provided by law, g v ng notice that the hearing
on said Resolution was to be held on the 6th day of July, 1970, at 8:00 P.M. in the
Council Chambers of the City Hall of the City of Auburn, and no objections thereto were
filed with the City Clerk or presented to the City Council at said hearing; and,
WHEREAS, the City Council, haying deemed that the Petition for vacation was proper
and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS
FOLLOWS:
section 1. That the followi.ng described portion of an alley situate between "D"
and "E" Streets N.E., north of 4th Street N.E., within the corporate limits of the City
of Auburn, more particularly desCribed as follows:
Beginning at the NE corner of Lot l, Block A, Arthur C. Ballard's Condict
Addition to Auburn as recorded in Volume 19, Page 88 of Plats, records of
King County, Washington; th E to the NW corner of Lot l, Block l, Lange's
First Addition to Auburn as recorded in Volume 25, P.age 36 of Plats, records
of King County, Washington; th S 105.18 ft. along the W merginal line of
aforesaid Lot 1, Block l, Lange'S First Addition; th W to the E marginal
line of Lot l, Block A, Arthur C. Ballard's Condict Addition; th N along
said W line 105.18 ft. to the P.O.B. Situate in the City of Auburn, County
of Ki.ng, State of Washington.

described hereinaboVe, shall be returned and belo.ng to the abutting plhOper~y Owners,
MARIA IDA GAGNON, VIRGIA ALLEN AND ARTHUR E. ANDERSON AND ANNA B. ANDFRSON, his wife,
of said portion of an alley situate between "D" and "E" Streets N.E., north of 4th
Street N.E., including, but not limited to, an easement fer overhead and underground
public utilities and for the retainage, by the City of Auburn, of the South 5 feet of
the alley of said vacated p~.eperty to be retained for the widening of the right-of-way
