AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE
VACATION OFA PORTION OF A CERTAIN ALLEY SITUATE WITHIN THE CORPORATE LIMITS
OFTHE CITY OF AUBURN, WASHINGTON.
WHEREAS, the City Council of the City of Auburn have passed and! adopted Resolutio~
No. 440 resolving that a public hearing Shall be had for the purpose of determining
whether or not the hereinafter described alley situate betWeen 3rd and 4th Streets N.E.,
East of."E" Street N.E., lying within the Corporate Limits of the City of Auburn shall
be vacated, said portion to be vacated being hereinafter legally described in Section 1
WHEREAS, notice of public hearing to vacate thePortion of a certain alley between
3rd and 4th Streets N.E., East of "E" Street N.E,, ]yi.ng within the Corporate Limits of
the City of Auburn, in the time and manner provided by law, giving noticelt~at the
hearing on said Resolution No. 440 was to be held on the 21st day of December, 1970, at
8:00 P.M. in the Council Chambers of the City Hall of the City of Auburn, and no objections
thereto were filed with the City Clerk or presented to the City Council at said hearing;
and,
WHEREAS, ~he City Council, haVing deemed that the PetitiOn for 'vacation was proper
and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBUP~N, WASHING'rON, DO ORDAIN AS
FOL~O~¢S:
Section 1. That the following described portion of a certain alley situate between
3rd and 4th Streets N.E., East of "E" Street N.E~, lying within the Corporate Limits of
the City of Auburn, more particularly described as follows:
Beginning at a point at the NE corner of Lot 5, Block 3, Lange's First
Addition to Auburn; th W along the N line of Lots 5 and 6 i;o the NW
corner of Lot 6; th N to the SW corner of Lot 3; th E along the S line
of Lots 3 and 4 to theSE corner of Lot 4; th S to the point of begin-
ning, ALL Said lots being in Block 3 Of Lange's First Addition to
Auburn.
Be and the same is hereby vacated, and the property lying in said portion of a certain
alley described hereinaboVe, shall be returned and belong to the abutting property
owners, AUBURN SCHOOE DISTRICT NO. 408, of said portion of a certain alley situate
between 3rd and 4th Streets N.E~, East of "E" Street N.E;, lying within the Corporate
Limits of the City of'Auburn.

Section 2. That this Ordinance Shall take effect five (5) days from and after its
passage, app~val and publication as provided byilaw.
