AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE
VACATION OF A PORTION OF STREET RIGHT,OF-WAY SITUATE WITHIN THE'. CORPORATE LIMITS
OF THE CITY OF AUBURN, WASHINGTON.
WHEREAS, the City Council of the City of Auburn have passed and adopted Resolution
No. 484 resolving that a public hearing sba? be had for the purpose of determining
whether or not the hereinafter described alley right-of-way situate on a portion lying
between 8th Street S.EJ and Auburn Way South between "D" and "F" Streets S.E. lying
within the corporate limits of the City of Auburn shall be vacated, said portion to be

WHEREAS, notice of public hearing to vacate the portion of a certain alley right-
of-way em a portion lying between 8th Street S.E. and Auburn Way South between "D" and
"F" Street S.E. lying within the corporate limits Df the City of Auburn, in the time
and manner provided by law, giving notice that the hearYng on said Resolution No. 484
was to be held on the 1st day of November, '971 at 8:00 P.M. in the Council Chambers
of the City Hall of the City of Auburn, and no objections thereto were filed with the
City Clerk or presented to the City Council at said hearing; and,
WHEREAS, the City Council, having deemed that the petition for vacation was proper
and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Sec~iin t. 'That t-he following described portion of a certain alley right-of-way
situate on a portion lying between 8th Street S.E. and Auburn Way South between "D"
and "F" Streets S.E. lying within the corporate limits of the City of Auburn, more
particularly described as follows:
All that por of the alley lying between Lots 3, ~, 22 & 23, Block l, Walnut Lawn
Addn to Auburn, as recorded in Vol. 21 of Plats, pg. 40, records of King County,
Washington, described as follows:
Begin at the NE cot of said Lot 22; th S 89°23'19'' W along the Nly boundary of
said Lot 22, 30.88 ft. to the point of curve of a curve to the right having a
radius of 17.14 ft., said point of curve being the TPOB; th 32.62 ft. along
said curve to its point of tangency on the Ely boundary of said Lot 3; th S
18°26'20" W along the Ely bounda~ of said Lots 3 and 23, 49.55 ft. to the N
bg~n.dary.O(~ S 25.9 ft. of said L~t 23; th N 89°23'~9".E 16.93 ft. to the
~my ~ounoary o~ said Lot 22~ th N 18 26'20" E along sa~d Wly boundary of Lot 22,
18.38 ft. to the point of curve of a'curve to the right having a radius of 10.00
ft.; th 12.38 ft. along said curve ot its point of tangency on the Nly boundary
of said Lot22, said point of tangency being the TPOB.
Be and the same is hereby vacated, and the property lying in said portion of a certain
alley right-of-way described hereinabove, shall be returned and belong to the abutting
property owner, MARSEARCH, INC., of said portion of a certain alley right-of-way situate
on a portion lying between 8th Street S.E. and Auburn Way South between "D" and "F"

Streets S.E~ lying within the corporate limits of the City of Auburn.'
section 2, That a public Utility easement be retained in that portion of the
alley legallY described in SeCtion 1 of this Ordinance, said utili~ easement lying
North of the North line Of Lot 22 extendedWesterly.
section 3. That this Ordinance Shall take effect five (5) days from and after
its passage, approval and publication, as provided by law.
