AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR
THE VACATION OF STREET UNIMPROVED RIGHT-OF-WAY FOR THE R. TIPPEY ROAD
AlGA.LAKE TAPPS ROAD IN THE SE 1/4 OF SE 1/4 SECTION 32, TWP 21 N, RANGE
5 E., W.M. SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN,
WASHINGTON.
WHEREAS, the City Council of the City of Auburn having passed and adopted
Resolution No. 558 resolving that a public hearing shall be had for the purpose
of deteminin~ Whe~e~'or not the hereinafter described unimproved right-of-way
situate on a portion R. Tippey Road aka Lake Ta@ps Road situate within the
corporate limits of the City of Auburn shall be vacated, said portion to be
vacated being hereinafter legally described in Section 1 of this Ordinance; and,
WHEREAS, notice of public hearing to vacate the portion of a certain
street unimproved right-of-way on a portion of R. Tippey Road aka Lake ~pps
Road within the corporate limits of the City of Auburn, in the time and manner
provided by law, 9ivin9 notice that the hearing on said Resolution No. 558 was
to be held on the 5 day of March, 1973, at 8:00 P.M. in the Council Chambers of
the City Hall of the City of Auburn, and no objections thereto were filed with
the City Clerk or pre~enteU to the City Council at said hearing; and,
WHEREAS, the City Council, having deemed that the petition for vacation
was proper and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ADBURN, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. That the followin9 described portion of a certain street
unimproved right-of-way situate on R. Tipped Road aka Lake Tapps Road within the
corporate limits of the City of Auburn, more particularly described as follows:
A strip of land 40 ft. wide in Section 32, Twp 21, R 5 E.W.M.
the center line of which runs as follows: Beginnin9 at a point
on the South line of said Section 32, 52.9 ft. West of the S.E.
corner to same; th N. 21°03' E. 150.1 ft., to the east line of
said Section 32. Also a strip of land 40 ft. wide in said
Section 32 the center line of which runs as follows: Beginning
at a point on the east line of said Section 32, 322.7 ft. North
of the S.E. corner of same: th N. 24o57' W. 180.4 ft., th N.
14°27'W, 200 ft; th N. 27°27m W, 145 ft; th N. 49°57' W., 155 ft.;

and Volume 5216/664.'
Be and the same is hereby vacated, and theproperty lying in said portion of a
certain street unimproved right,of_way desCribed hereinabove, shall be retUrned
and belong to the abutting property owner of said portion of a certain street
umimproved right'of-way situate on a portion of R. Tippey Road aka Lake Tap@s
Road in the SE 1/4 of SE 1/4 Section 32, TWP 21N. Range 5 E. WM. lying within
the corporate limits of the City of Auburn.
Section 2. That this Ordinance Shall take effect five (5) days after
its passage, approval and publication, as provided by law.
