Home My WebLink About2826 : t ~ LO l~ o C"1 N CO o ~ r--- ORDINANCE NO. 2 8 2 6 AN QRDINANCEOF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF A CERTAIN PARCEL OF' LAND LOCATED ON THE EAST SIDE OF "M" STREET SOUTHEAST, SITUATE WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FRoM R-4 TO CONDITIONAL USE PERMIT. WHEREAS, il petition dated May 8, ]974, together with. plot plans and exterior elevations therefor has been submitted to the Council of the City of Auburn, by the Auburn Eag1 es, requesting a Conditional Use Permi t whi ch woul d allow the construction of a lodge hall and related facilities on a parcel of land located on the east side of M Street Southeast in the 700 Block, which property hereinafter described in Section 1 of this Ordinance and which property presently carries an R-4 (Multiple Family) classification; and, WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and, WHEREAS, the Planning Commission held a public hearing to consider the request in the City Hall of the City of Auburn at 7;30 P.M. on June 4, 1974, and subsequent thereto the City Planning Commission approved the issuance of the Conditional Use Permit, finding that the proposed use illustrated by the site development plans of the petitioner would not be unduly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and, WHEREAS, the City Council of the City of Auburn held a public hearing to consider said petition in the City Hall of the City of Auburn at 8;00 P.M. on July 1, 1974, ilt the conclusion of which the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE~ THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS; Section 1. That a conditional use permit be granted for the purpose of constructing a lodge hall and related facilities on the following described property, to'"wi t; 7-9-74 Page One . .. Beginning on the south line of Section 18, Township 21 North, Range 5 East, W.M., inKing County, Washington, dt,stance of 1000 feet from the southeastdcorner thereof; thence west along said south line, 284.84 feet, (!lore or less, to the east ,1586 ,',", of "M"Street S.E.; thence north along said east limt'.450 fflet~ " thence east parallel with thesouthline 120 feet; thence n~w:th" ~ parallel with "M" Street S.W. 90 feet; thence east parallel with the south line to intersect a line drawn from the point of beginning to a point on the south line of Northern Pacific Railway (Palmer Out'-Off) distant 920 feet east from the dividing line between the southeast quarter of the southeast 1/4 and ' government lot 14 ; thence southwesterly along sai d intersected line to the point of beginning. . in accordance with the plot plans and exterior elevations for said development submitted with the request for conditional use permit, a copy of which is attached hereto, desi gnated Exhi bit "A" and by thi s reference made a part hereof as though. set forth herei n in full. Section 2. That the lodge building shall be restricted to one (1) story in height. Section 3. That a six (6) foot high screen fence shall be constructed on the north, south and east property 1 i ne and/or a soli d screen hedge to be a mi nimum of four (4) feet at the time of p 1 anti ng. Secti on 4. That all outdoor li ghti ng be di rected away from pri vate property adjacent. Section 5. That there be no outside public address systems. Section 6; That the planting areas as shown on the plans be planted in accordance with the City of Auburn Landscape requirements. Section 7. That there be no lighted advertising sign constructed within 100 feet of "M" Street S. E. A gound si gn wi th the following - F. O. E. - may be placed in the planting screen area adjacentt() "M" Street S.E. This ground sign may have indirect lighting. Final design and location shall be subject to the approval of the City Council Planning and Beautification Committee. 7-9-74 Page Two c' "'l:t Section 8. In the event the City of Auburn Public Works Department l.O 8 determines that to provide for traffic safety on "M" Street Southeast, a left C"1 N turn 1 ane shoul d be constructed on "M" Street Southeast to accommodate the a) ~ left turn traffic generated by this facility. The owners shall participate t"'- in the construction of said left turn lane in an amount to be determined by the Street Committee of the Auburn City Council. Section 9. That the plot plan submitted with the application shall be attached to and become a part of the permit. Section 10. That the City Clerk of the City of Auburn is hereby authorized and di rected to fil e a certified copy of thi s Ordi nance wi th the King County Auditor's Office. Section 11. That this Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
