HomeMy WebLinkAbout2887ORDINANCE NO. 2 8 8 7 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF A PORTION OF STREET RIGHT-OF-WAY ON "J" STREET NORTHEAST NORTH OF 4TH STREET NORTHEAST, SITUATE WITHIN THE CORPOPJ~TE LIMITS OF THE CITY OF AUBURN, WASHINGTON. WHEREAS, the City Council of the City of Auburn, have passed and adopted Resolution No. 672,~esolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described street right-of-way situate on a portion of "J" Street Northeast North of 4th Street Northeast, within the corporate limits of the City of Auburn shall be vacated, said portion to be vacated beinghereinafter legally described in Section 1 of this Ordinance; and, WHEREAS, notice of public hearing to vacate the portion of a certain street right-of-way known as "J" Street Northeast North of 4th Street Northeast, lying within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 672 was to be held on the 21st day of April, 1975, at 8:00 P.M. in the Council Chambers of the City Hall of the City of Auburn, Washington, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and, WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described portion of a certain street right- of-way situated on a portion of "J" Street Northeast North of 4th Street Northeast, within the corporate limits of the City of Auburn, more particularly described as follows: Beginnin9 at the Southeast corner Lot 6, Block 6, the Plat of Poplar- wood Addition to Auburn as recOrded in Volume 32 of Plats at page 5, records of King County, Washington; thence North 3°10' East along the Easterly margin of said Lot 6, 108.78 feet to the Northerly boundary of said Plat; thence North 79°23' East along said Northerly boundary, 30.89 feet to the Easterly boundary of said Plat; thence South 3°10' West along said Easterly boundary, 4-24-75 Page One 120.23 feet to a point on a curve, said curve having a radius of 40.00 feet, a central angle of 44028'40'' and a radial bearing of South 33°10'03'' West; thence Westerly along said curve 31.05 feet to the Point of Beginning. Be and the same is hereby vacated, and the property lying in said portion of a certain street right-of-way described hereinabove, shall be returned and belong to the abutting property owner, DAVE BOTTING, of said portion of a certain street right-of-way situate on a portion of "J" Street Northeast North of 4th Street North- east, lying within the corporate limits of the City of Auburn. Section 2. That the request for vacation of street right-of-way be granted subject to a public utility easement over, across, upon and underneath the entire vacated street for ingress and egress for the purpose of installing and maintaining all public utilities. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. Section 4. That this Ordinance shall take effect five (5) days from and after its passage, approval and publication, as provided by law.
