AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE
ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0.
287, WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING
FOR CONSTRUCTION OF EXCAVATION, BALLASTING, CURB AND GUTTER,
ASPHALT-CONCRETE SURFACING, STORM DRAINAGE, 8 INCH SANITARY
SEWER, 6 INCH SIDE SEWERS, 6 INCH CAST IRON WATER':MAIN AND FIRE
HYD}2ANT ON 21ST STREET SOUTHEAST BETWEEN A POINT 325 FEET EAST
OF HEMLOCK STREET THENCE EXTENDING EAST A DISTANCE OF 325 FEET,
INSIDE THE CORPORATE LIMITS OF THE CITY OF AUBURN; AS PROVIDED
BY ORDINANCE N0. 2892, OF THE CITY OF AUBURN, AND LEVYING AND
ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS,
PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL.
WHEREAS, the assessment roll levying the special assessments against
the properties located in the Local Improvement District No. 287 of the City of
Auburn, Washington, created under Ordinance No. 2892, has been filed with the
Ci ty C1 erk of the Ci ty of Auburn, as provi ded by 1 aw; and
WHEREAS, notice of the time and place of hearing thereof and making
objections and protests to said roll was duly published at and for the time and
in the manner provided by law, fixing the time and place of hearing thereQn for
the 2nd day of February, 1976, at the hour of 8:00 P.M. in the Cvuncil Chambers
of the City Hall of Auburn, Washington, and further notice thereof was duly mailed
by the City Clerk to each property owner shown on said roll; and
WHEREAS, at the time and place fixed and designated in said notice of
hearing was duly held and no protests were filed at said hearing; and
WHEREAS, after the hearing was held the assessment roll was accepted
as presented and ordered confirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. That there is hereby in all respects approved and confirmed
the assessment and assessment roll in Local Improvement District No. 287, providing
for construction of excavation, ballasting, curb and gutter, asphalt-concrete sur-
facing, storm drainage, 8 inch sanitary sewer, 6 inch side sewers, 6 inch cast iron
water main and fire hydrant on 21st Street S.E. between a point 325 feet East of
Hemlock Street thence extending East a distance of 325 feet, inside the corporate
limits of the City of Auburn, according to plans prepared and on file in the office
of the City Engineer of the City of Auburn, for the benefit of the following des-
cribed property:

West 5 acres of East 15 acres of South 20 acres of
the NW 1/4 of SW 1/4. Less North 310 feet situated
in Section 21, Township 21 North, Range 5 EWM, City
of Auburn, County of King, State of Washington.
West 5 acres of East 15 acres of South 20 acres of
NW 1/4 of SW 1/4 Less North 310 feet, Less West
160 feet of North 160 feet Less South 150 feet thereof,
situated in Section 21, Township 21 North, Range 5 EWM,
City of Auburn, County of King, State of Washington.
That portion of Section 21, Township 21 North, Range 5,
EWM, described as follows: Th South 150 feet of the
West 5 acres of the East 15 acres of the South 20
acres of the Northwest 1/4 of the Southwest 1/4, City
of Auburn, County of King, State of Washington.
Section 2. That each of the lots and other property upan said assessment
roll is hereby declared to be especially benefited by said improvements in at least
the amount charged against the same, and that the assessment appearing against each
of the same is in proportion to the several assessments appearing on said roll. That
all of the property shall be assessed according to the lineal frontage of the property
abutting said property to be improved and shall be assessed according to their
proportionate share of the several assessments appearing upon the said assessment
roll and there is hereby levied and assessed against such lots and other property
appearing upon said roll, the amount finally charged therein against the same;_said
amount, or any portion thereof, may be paid at any time within thirty (30) days from
the date of the first publication of the Notice of Collection of said assessments
without penalty, interest or cost; thereafter the sum remaining unpa7d, if any, may
be paid in ten (10) equal annual installments, with interest on the whole unpaid
sum at the rate of seven and one-half percent (7.5%) per annum.
Commencing with the first year after the last day, such assessments, or
any portion thereof, may be paid without penalty, interest or cost (30 days from
the date of the first publication of the Treasurer's Notice of Collection of
Assessments) and each year thereafter, one of said installments, together with
the interest due, shall be collected as provided by law and the Ordinances of the
City of Auburn, assessments or installments of assessments not paid when due shall
be delinquent and there shall be added to the same a penalty of five percent (5%)

r of the amount of the overdue installment and interest, and such penalty shall become
a part of the lien upon the property assessed.
Section 3. All monies collected by the City Treasurer upon any of
the assessments levied, as authorized herein, shall be paid jnto "Local
Improvement District No. 287 Fund" created by Ordinance No. 2892, and shall
be used only for the purpose of redeeming warrants and/or bonds drawn upon
or issued against said fund.
Section 4. That this Ordinance shall take effect five (5) days from and
after its passage, approval and publication, as provided by law.

I further certify that said Ordinance No. 3048 was duly passed by the
Council and approved by the Mayor of the said City of Auburn and published as
provided by law in the Auburn Globe-News, a weekly newspaper published in the
City of Auburn, and of general circuZation therein, on the 27th day of
February , A.D., 19 76 .
