AN ORDINANCE OF THE CITY OF AUBURN, WASHZNGTON, PRQVZQING FQR AN AMENDMENT TO
00 AN EXISTING SPECIAL PROPERTY USE PERMIT TO CONSTRUCT EIGHT (8)
1.0 4-PLEX UNITS INSTEAD OF ONE (1) 26 UNIT AND TWO (2) 28 UNIT
APARTMENT BUILDINGS ON THE PROPERTY LOCATED ON THE NORTH SIDE

~ WHEREAS, a petition dated November 12, 1975, together with plot plans and
,
exterior elevations therefor has been submitted to the Council of the City of
Auburn, by KEITH B. LILE, requesting an amendment to an existing Special Property
Use Permit which would allow the construction of eight (8) four plex units instead
of one 26 unit and two (2) 28 unit apartment houses reducing the density from 82
units to 32 units also to change design and have separate ownership of said four-
plexes per the requirements of City of Auburn Zoning 4rdinance No. 1702 as amended
Chapter 11.16.015, Sub-section (3-H), Dwellings, Duplexes and Multi-Family, located
on the north side of 23rd Street Southeast, between "D" and "F" Streets Southeast,
which pr.operty hereinafter described in Section 1 of this Ordinance; and
WNEREAS, said request above referred to was referred by the City Council
to the City Planning Commission for study and public hearing thereon; and
WHEREAS, the Planning Commission held a public hearing to consider the
request in the City Hall of the City of Auburn at 7:30 P.M. on January 6, 1976,
and subsequent thereto the City Planning Comission approved the issuance of the
amendment of the existing Special Property Use Permit, finding that the proposed
use illustrated by the site development plans of the petitioner would not be unduly
detrimental to the adjacent and surrounding properties and the enjoyment thereof; and
WHEREAS, the City Council of the City of Auburn held a public hearing to
consider said petition in the City Hall of the City of Auburn at 8:00 P.M. on
February 2, 1976, at the conclusion of which the City Council concurred with the
recommendations of the Planning Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. That an amendment to the existing Special Property Use Permit
be granted for the purpose of constructing eight (8) four-plex units instead of
one (1) 26 unit and two (2) 28 unit apartment houses reducing the density from 82
units to 32 units also to change design and have separate ownership of said four-
pp plexes per the requirements of City of Auburn Zoning Ordinance No. 1702 as amended,

on the following described property, to-wit:

~ The North 1/2 of the West 1/2 of the North 1/2 of the South
1/2 of the Southeast 1/4 of the Southwest 1/4 of Section 19,
Township 21 North, Range 5 E.W.M. Except the East 120 feet of
said real estate as measured along the South line thereof, and
with the West line of said 120 feet running parallel with the
East line of the real estate first above described. And ex-
cept streets and roads, situate in the City of Auburn, County
of King, State of Washington.
in accordance with the plot plans and exterior elevations for said development
submitted with the request for the amendment to the existing 200604fty Use
fs' a copy of which is attached hereto, designated4i;t'Ib`r'0and by this
reference made a part hereof as though set forth in full herein.
Section 2. That a six (6) foot high screen fence be constructed along
the north property line.
Section 3. That the City Clerk of the City of Auburn is hereby authorized
and directed to file a certified copy of this Ordinance with the King County
Auditor's Office.
Section 4. That this Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.
