AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVTDING FOR THE REZONING OF
A PARCEL OF LAND 7.07 ACRES IN SIZE LYING ON THE WEST SIDE OF
"M" STREET N.E. BETWEEN 18TH AND 20TH STREETS N.E., SZTUATE
WTTHIN THE CZTY OF AUBURfV, WASHINGTON, CHANGING THE ZONING
CLASSIFICATION THEREOF FROM R-2 TO A CONDITIONAL USE PERMIT.

c~ WHEREAS, a petition dated October 31, 1975, together with plot plans and

~ exteri~ol^ elevations therefor has been submitted to the Council of the City of Auburn,

~ by DAVTD W. and PEARL E. DEHLINE, requesting a Conditional Use Permit which would
allow for the construction of 64 living units on a parcel of land 7.07 acres in
size lying on the west side of "M" Street Northeast between 18th and 20th Streets
Northeast, which property hereinafter described in Section 1 of this Ordinance and
which property presently carries an R-2 (Single Family) classification; and
WHEREAS, said request above referred to was referred by the City Council
to the City Planning Commission for study and public hearing thereon; and
WHEREAS, the Planning Commission held a public hearing to consider the
request in the City Hall of the City of Auburn at 7:30 P.M. on February 3, 1976,
and subsequent thereto the City Planning Commission approved the issuance of the
Conditional Use Permit, finding that the proposed use illustrated by the site
development plans of the petitioner would not be unduly detrimental to the adjacent
and surrounding properties and the enjoyment thereof; and
H[HEREAS, the City Council of the City of Auburn held a public hearing to
consider said petition in the City Hall of the City of Auburn, at 8:00 P.M. on
March 1, 1976, at the conclusion of which the City Council concurred with the
recommendations of the Planning Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That a Conditional Use Permit be granted for the purpose of
constructing 64 living units on the following described property, to-wit:

Beginning at a point in Section 7, Township 21 North, Range 5
East, W.M., which is 50 rods (825 feet) West of the Northeast
corner of the South 1/2 of the Donation Land Claim of the Heirs
at Law of William H. Brannon and his wife, Elizabeth Brannon,
both deceased, designated as Claim No. 37, thence South 0°22'
East 335.0 feet to the True Point of Beginning of this description;
thence continuing South 0°22' East 664.31 feet to a point; thence
West 412.5 feet to a point; thence North 0°02' East 812.40 feet,
more or less, to a point; thence North 89°87' East 230.5 feet to
~ a point; thence South 0°30' West 147.0 feet to a point; thence
~ East 182.0 feet to the True Point of Beginning; LESS road,
0 situated in the City of Auburn, County of King, State of

Section 2. That the plot plans and exterior elevations be attached to
and become a part of the permit.
Section 3. That the City Clerk of the City of Auburn is hereby authorized
and directed to file a certified copy of this Ordinance with the King County Auditor's
Office.
Section 4. That this Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.
