HomeMy WebLinkAbout3060 ~ ORDINANCE N0. 3 0 6 0 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVID,J,N,G FOR'-_; crti THE VACATION OF STREET RIGHT-OF-WAY, SITUATE WEST 340 FEET OF c~ 5TH STREET NORTHEAST LYING NORTH OF THE AUBURN SCHOOL DISTRICT ADMINISTRATION BUILDING, WITHIN THE CORPORATE LIMITS OF THE CI# ;j OF AUBURN, WASHINGTQN. ~ ~ r~ WHEREAS, the City Council of the City of Auburn, have passed and adopted ~ Resolution No. 712, resolving that a public hearing shall be had for the purpose ~ of determining whether or not the hereinafter described street right-of-way 0 situate west 340 feet of 5th Street Northeast lying north of the Auburn School District Administration Building, within the corporate limits of the City of ~a -~s Auburn, shall be vacated, said portion to be vacated being hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain street right-of-way situate west 340 feet of 5th Street Northeast, lying north of the Auburn School District Administration Building, within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing orr said Resolution No. 712 was to be had on the 5th day of April, 1976, at 8:00 P.M. in the Council Chambers of the City Ha11 of the City of Auburn, Washington, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 2. That the request for vacation of street right-of-way be granted subject to a public utility easement over, across, upon and underneath the entire vacated street for ingress and egress for the purpose of installing and maintaining all public utilities. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor.
