ORDINANCE N0. 3 0 6 1 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FORc'+ r, THE VACATION OF STREET RIGHT-OF-WAY SITUATE 622 FEET NORTH OF r3 AUBURN ENUMCLAW HIGHWAY ADJACENT TO CHINOOK ELEMENTARY SCHOOL, ~CD SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, .0 WASHINGTON. cq Oct ui ~:T c~ '13 WHEREAS, the City Council of the City of Auburn, have passed and rl- 0 adopted Resolution No: 713, resolving that a public hearing shall be had for «o a the purpose of determining whether or not the hereinafter described street ° right-of-way situate 622 feet north of the Auburn Enumclaw Highway adjacent to the Chinook Elementary School, within the corporate limits of the City of ~ Auburn, shall be vacated, said portion to be vacated being hereinafter legally ~ ~ described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain street right-of-way 622 feet north of the Auburn Enumclaw Highway adjacent to the Chinook Elementary School, lying within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearin.g,Qn said Resolution No. 713 was to be held an the 5th day of Apri1, 1976, at 8:00 P.M. in the Council Chambers of the City Hall of the City of ' Auburn, Washington, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and WHEaEAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described portion of a certain street right-of-way situated 622 feet north of the Auburn Enumclaw Highway adjacent to the Chinook Elementary School, within the corporate limits of the City of Auburn, more particularly described as follows: The East 10 feet of the West 1/2, NW 1/4, SE 1/4, SW 1/4, together with the West 10 feet of the East 1/2, North 1/2, West 1/2, SE 1/4, SW 1/4, All in Section 21, Township 21 North, Range 5, EWM, situated in the City of Auburn, County of King, State of Washington. That the request for vacation of street right-of-way be ~ granted subject to a public utility easement over, across, upon and underneath C:) t~ tPie entire vacated street for ingress and egress for the purpose of installing and maintaining all public utilities. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. Section 4. That this Ordinance shall take effect five (5) days from and after its passage, approval and publication, as provided by law.
