AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING
FOR THE VACATION OF STREET RIGHT-OF-WAY SITUATED BETWEEN 37TH
SOUTHEAST AND 41ST SOUTHEAST, SITUATE WITHIN THE CORPORATE
lIMITS OF THE CITY OF AUBURN,

WHEREAS, the City Council of the City of Auburn, have passed and
adopted Resolution No. 750, resolving that a public hearing shall be had for
the purpose of determining whether or not the hereinafter described street

right-of-way located between 37th Southeast and 41st Southeast, within the

corporate limits of the City of Auburn, shall be vacated, said portion to
be vacated being hereinafter legally described in Section 1 of this Ordinance;
and
WHEREAS, notice of public hearing to vacate the portion of a certain
street right-of-way located between 37th Southeast and 41st Southeast, lying
within the corporate limits of the City of Auburn, in the time and man~cr
provided by law, giving notice that the hearing on said Resolution No. 750
was to be held on the 20th day of December, 1976, at 8:00 P.M. in the Council
Chambers of the City Hall of the City of Auburn, Washington, no objections
thereto were filed with the City Clerk or presented to the City Council at
said hearing; and
WHEREAS, the City Council, having deemed that the petition for
vacation was proper and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOllOWS:
Section 1. That the following described portion of a certain street
right-of-way located between 37th Southeast and 41st Southeast, within the
corporate limits of the City of Auburn, Washington, and more particularly
described as follows:

That portion of Government Lot 4 in Section 30,
Township 21 North, Range 5 East W.M., described
as follows:
The East 8 feet of the West one-half of said Lot
4; Less the S 30 feet, the West 8 feet of the East
one-half of said Lot 4; Less the S 30 feet, the
South 8 feet of the North one-half of the West one-
half of said Lot 4, the North 8 feet of the South
one-half of the West one-half of said Lot 4, City
of Auburn, County of King, State of Washington.
be and the same is hereby vacated, and the property lying in said portion of
a certain street right-of-way described hereinabove, shall be returned and
belong to the abutting property owners, THE CARLYLE GROUP, of said portion
of a certain street right-of-way located between 37th Southeast and 41st
Southeast, lying within the corporate limits of the City of Auburn.
Section 2. That the request for vacation of street right-of-way be
granted subject to a public utility easement over, across, upon and under-
neath the entire vacated street for ingress and egress for the purpose of
installing and maintaining all public utilities.
Section 3. Upon the passage, approval and publication of this
Ordinance, the City Clerk shall cause a certified copy of this Ordinance to
be recorded in the office of the King County Auditor.
Section 4. That this Ordinance shall take effect and be in force
five (5) days from and after its passage, approval and publication, as
provided by law.
