AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR
THE ANNEXATION TO THE CITY OF AUBURN OF A CONTIGUOUS AREA OF LAND
LYING ADJACENT TO THE NORTHERLY MARGINAL LINE OF THE EXISTING CITY
LIMITS OF THE CITY OF AUBURN, WHICH LAND IS DESCRIBED IN A PETITION
DULY FILED WITH THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON.
WHEREAS, the City Council of the City of Auburn was notified by owners
of property having more than ten percent in value of the assessed valuation
within the proposed area to be annexed, that they desired to circulate a
petition to commence annexation proceedings to the City of Auburn; and
WHEREAS, the City Council of the City of Auburn subsequently authorized
the circulation of the petition within the proposed area to be annexed; and
WHEREAS, the petition for annexation of the property hereinafter described
was duly filed with the City Council of the City of Auburn on the 16th day of
May, 1977, which petition was signed by the owners of more than 75% in value of
all of the property lying within the limits of the proposed area to be annexed
according to the assessed valuation for general taxation of the property for
which an annexation is petitioned, said petition setting forth the legal des-
cription of the property to be annexed and being accompanied by a plat outlining
the boundaries of said area sought to be annexed; and
WHEREAS, the City Council of the City of Auburn fixed a date for public
hearing to be held at 8:00 P.M. in the temporary Council Chambers at the Auburn
School District Administration Building, on July 5, 1977, setting forth notice
of said public hearing for annexation to be published in the official City
newspaper of the City of Auburn in one issue of said newspaper, and providing
for the posting in three public places within the area proposed for' annexation
of copies of said notice of public hearing; and
WHEREAS, notice of public hearing of said petition of annexation to the City
of Auburn has been duly published in the official newspaper of the City of Auburn
in one regular issue of said newspaper, and the said notice of public hearing
having been posted in three public places within the area proposed for annexation

by the City Clerk of the City of Auburn, and said public hearing being held at
8:00 P.M. in the temporary Council Chambers at the Auburn School District Adminis-
tration Building on July 5, 1977, and the City Council of the City of Auburn
having determined that said annexation is in the best interest and welfare of
the City of Auburn, did accept and approve the petition above described and
directed the filing of a notice of its intention to annex the hereinafter des-
cribed property with the Boundary Review Board as required by Section 9 of
Chapter 189 of Laws of the State of Washington for the year 1967;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AS FOLLOWS:
Section 1. That the petition for annexation of the property hereinafter
described in Section 6 of this Ordinance has been duly and properly filed with
the City Council of the City of Auburn, and complies with all requirements of law.
Section 2. That by regular motion adopted and passed by the City Council
on the 20th day Of June,1977, it was ordered that a public hearing be held on
said petition for annexation at 8:00 P.M. in the temporary Council Chambers at
the Auburn School District Administration Building, on July 5, 1977, providing
for the proper notice to be published and posted according to law.
Section 3. That proper notice of public hearing was duly published in the
official newspaper of the City of Auburn, and was duly posted in three public
places within the area proposed for annexation hereinafter described, and that
a public hearing was held at 8:00 P.M. in the temporary Council Chambers at the
Auburn School District Administration Building on the 5th day of July, 1977.
Section 4. That at the conclusion of the public hearing in the temporary
Council Chambers of the City of Auburn on the 5th day of July, 1977, the City
Council did approve the petition for annexation and directed the filing of a notice
of its intention to annex the hereinafter described property with the Boundary
Review Board as required in Section 9 of Chapter 189 of the State of Washington
Laws for the year 1967.

Section 5. That notice of intention to annex was filed with the Boundary
Review Board effective November 30, 1977 and the Boundary Review Board received
no request for review and did not itself choose to invoke jurisdiction; therefore,
inasmuch as the sixty days period subsequent to filing provided for in RCW 36.93.100
has elapsed, the Notice of Intention was deemed approved and the Boundary Review
Board forwarded their findings to the City Council of the City of Auburn.
Section 6. That the property lying contiguous to the northerly marginal line
of the existing City limits of the City of Auburn hereinafter described be and the
same is hereby annexed to the City of Auburn, said property being more particularly
described as follows:
South 1/2 of portion of Southwest 1/4 of Southwest 1/4
and South of County Road #941, Less State Road. Section
36, Township 22, Range 4 E.W.M., County of King, State of
Washington.
Section 7. That the effective date of the annexation of the above described
property to the City of Auburn shall be the effective date of the passage of this
Ordinance providing for such annexation.
Section 8. That in accordance with the terms of the petition for annexation
of the above described property, the area to be annexed shall assume the indebted-
ness of the City of Auburn existing at the effective date of the passage of this
Ordinance.
Section 9. That this Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.
