HomeMy WebLinkAbout3889 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 2 ORDINANCE NO. 3 8 8 9 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR 3 THE ANNEXATION TO THE CITY OF AUBURN OF A NON-CONTINGUOUS AREA OF LAND 2.07 ACRES IN SIZE LOCATEO ON THE SOUTHWEST CORNER OF 304TH AND 132ND 4 AVENUE S.E., FOR MUNICIPAL PURPOSES OF MAINTAINING AND ESTABLISHING A MUNICIPAL WATER RESERVOIR. WHEREAS, an interest in certain real property (more fully described hereinafter) is a perpetual easement for a municipal water reservoir owned by the City of Auburn; and WHEREAS, the City of Auburn is utilizing the interest in said real pro- perty for the municipal purposes of maintaining and establishing a municipal water reservoir; and WHEREAS, the City Council of the City of Auburn at its rel~ularly scheduled meeting of February 7, 1983, authorized the Planning Department of the City of Auburn to prepare and forward a Notice of Intention to annex the hereinafter described property with the Boundary Review Board as required by Section 9 of Chapter 189 of the Laws of the State of Washington for the ye¡¡r 1967; WHEREAS, the Auburn City Council at a regularly scheduled meeting in the City Hall Council Chambers of the City of Auburn on thE! 7th day of February, 1983, did authorize the Planning Department of the City of Auburn to present and forward a notice of its intention to annex for municipal purposes the hereinafter described property with the Boundary Review Board as required in Section 9 of Chapter 189 of the State of Washington Law foy' the Year 1967. WHEREAS, notice of intention to annex was filed with the Boundary Review Board effective March 9, 1983, and the Boundary Review Board received no request for review and did not itself choose to invoke jurisdiction; there- fore, inasmuch as the sixty-day period subsequent to filing py'ovided for in RCW 36.93.100 has elapsed, the Notice of Intention was deemed approved as of May 8, 1983, and the Boundary Review Board forwarded their findings to the City Council of the City of Auburn. That the following interest in the following described real property, consisting of a perpetual easement for a municipal water reservoir, said real property situated in an unincorporated area in the County of King, State of Washington, and which is owned in fee by the City of Auburn, is hereby annexed to the City of Auburn, said property being more, particularly described as follows, to-wit: The east 396.03 feet of the South 246.02 feet of the NE~ of the NE~ of the NE~ of Section 9, Twp 21 N, R 5 EWM, in King County, WA less County Road. Section 2. That the effective date of the annexation of the above described property to the City of Auburn shall be the effective date of the passage of this Ordinance providing for such annexation. Section 3. The Mayor is hereby authorized to implement such administra- tive procedures as may be necessary to carry out the directions of this legislation. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
