ORDINANCE NO. 3 9 1 5
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR
3 THE ANNEXATION TO THE CITY OF AUBURN OF A CONTIGUOUS AREA OF LAND 5.97
ACRES IN SIZE LOCATED AT THE NORTHEAST CORNER OF 58TH AVENUE SOUTH AND
4 24TH STREET N.W, WHICH LAND IS DESCRIBED IN A PETITION DUl.Y FILED WITH THE
CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON.

6 WHEREAS, the City Council of the City of Auburn was notified by owners of
7 property havin9 more than ten percent in value of the assessed valuation
8 within the proposed area to be annexed, that they desired to circulate a peti-
9 tion to commence annexation proceedings to the City of Auburn; and
10 WHEREAS, the petition for annexation of the property hereinafter described
11 was duly filed with the City Council of the City of Auburn on the 5th day of
12 July, 1983, which petition was signed by the owners of more than 75% in value
13 of all of the property lying within the limits of the proposed area to be
14 annexed according to the assessed valuation for general taxation of the pro-
15 perty for which an annexation is petitioned, said petition setting forth the
16 legal description of the property to be annexed and being accompanied by a
17 plat outlining the boundaries of said area sought to be annexed; and
18 WHEREAS, the City Counci 1 of the City of Auburn fixed a date for public
19 hearing to be held at 8:00 P.M. in Council Chambers of the Auburn ,City Hall on
20 July 18, 1983, setting forth notice of said public hearing for annexation to
21 be published in the official City newspaper of the City of Auburn in one issue
22 of said newspaper, and providing for the posting in three public places within
23 the area proposed for annexation of copies of said notice of public hearing;
24 and

WHEREAS, notice of public hearing of said petition of anneution to the
26 City of Auburn has been duly published in the official newspapei' of the City
27 of Auburn in one regular issue of said newspaper, and the said notice of
28 public hearing having been posted in three public places within the area pro-
29 posed for annexation by the City Clerk of the City of Auburn, and said pub1 ic
30 hearing being held at 8:00 P.M. in the Council Chambers of the tluburn City

Hall on July 18, 1983, and the City Council of the City of Auburn having
determined that said annexation is in the best interest and welfare of the
City of Auburn, did accept and approve the petiton above described and
directed the filing of a notice of its intention to annex the hereinafter
described property with the Boundary Review Board as required by Section 9 of
Chapter 189 of Laws of the State of Washington for the year 1967;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AS FOLLOWS:
Section 1. That the petition for annexation of the proper"ty hereinafter
described in Section 6 of this Ordinance has been duly and properly filed with
the City Council of the City of Auburn, and complies with all requirements of
law.
Section 2. That by regular motion adopted and passed by the City Council
on the 5th day of Ju 1y, 1983, it was ordered that a pub 1 ic heari ng be had on
said petition for the annexation at 8:00 P.M. in the Council Chambers of the
Auburn City Hall on July 18, 1983, providing for the proper notice to be
published and posted according to law.
Section 3. That proper notice of pUblic hearing was duly published in the
official newspaper of the City of Auburn, and was duly posted in three public
places within the area proposed for annexation hereinafter described, and that
a pUblic hearing was held at 8:00 P.M. in the Council Chambers of the Auburn
22 City Hall on the 18th day of July, 1983.

Section 4. That at the conclusion of the public hearing in the City Hall
24 Counci 1 Chambers of the City of Auburn on the. 18th day of July" 1983, the City
25 Council did approve the petition for annexation and directed the filing of a
26 notice of its intention to annex the hereinafter described property with the
27 Boundary Review Board as required in Section 9 of Chapter 189 of the State of .
28 Washin9ton Law for the Year 1967.

Section 5. That notice of intention to annex was filed with the Boundary
30 Review Board effective August 5, 1983, and the Boundary Review Board received

1 no request for review and did not itself choose to invoke jUI"isdiction; there-
2 fore, inasmuch as the sixty-day period subsequent to filing provided for in
3 RCW 36.93.100 has elapsed, the Notice of Intention was deemed approved as of
4 September 22, 1983, and the Boundary Review Board forwarded their findings to
5 the City Council of the City of Auburn.
6 Section 6. That the property lying contiguous on the northeast corner of
7 58th Avenue South and 24th Street N.W. 5.97 acres in size, hereinafter
8 described be and the same is hereby annexed to the City of Auburn, said pro-
9 perty being more particularly described as follows, to-wit:
10 Lots 6, 7, 8 and g, Block 3, Auburn Heights Park Division No.2 as
recorded in Plats, Volume 49, page 99, Records of King County, Washington
11 and situated in Section 11, Township 21 North, Range 4 EWM, County of
King, State of Washington.
Section 7. That the effective date of the annexation of the above
described property to the City of Auburn shall be the effective date of the
passage of this Ordinance providing for such annexation.
Section 8. That in accordance with the terms of the petition for annexa-
tion ,of the above described property, the area to be annexed shall assume the
indebtedness of the City of Auburn existing at the effective date of the
passage of this Ordinance.
Section 9. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.

1 Section 10. This Ordinance shall take effect and be in force five (5)
2 days from and after its passage, approval and publication, as provided by law.
