OF ALLEY RIGHT-OF-WAY. SITUATEO ON THAT PORTION OF LAN
AS A UBUC ALLEY LOCATED A..ROXmATELY 105 FEET NORTH OF
FOURTH STREET N.E. AND APPROXIMATELY 85.5 FEET EAST OF "E" STREET N.E.,
WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, the City Council of the City of Auburn, Washington, have passed
and adopted Resolution No. 1722, resolving that a public hearing shall be had
for the purpose of determining whether or not the hereinafter described alley
right-of-way located on that portion of land designateU as a public alley
located approximately 105 feet north of Fourth Street Northeast and approxima-
tely 85.5 feet east of "E" Street Northeast, within the corporate limits of.
the City of Auburn shall be vacated, said portion to be vacated being
hereinafter legally described in Section 1 of this Ordinance; and
WHEREAS, notice of public hearing to vacate the portion of a certain
~lley right-of-way located on that portion of land designated as a public ~
alley located approximately 105 feet north of Fourth Street Northeast and
approximately 85.5 feet east of "E" Street Northeast, within the corporate
limits of the City of Auburn, in the time and manner provided by law, giving
notice that the hearing on said Resolution No. 1722 was held on the 17th day
of February, 1987, at 7:30 P.M. in the Council Chambers of the Auburn City
Hall, no objections thereto were filed with the City Clerk or presented to the
City Council at said hearing.
WHEREAS, the Auburn City Council at their regular meeting of February 17,
1987. having deemed that the petition for vacation was proper and that no
vested rights would be affected by the same.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the following described portion of a certain alley
right-of-way situated on that portion of land designated as a public alley
located approximately 105 feet north of Fourth Street Northeast and approxima-
tely 85.5 feet east of "E" Street Northeast, within the corporate, limits of
the City of Auburn, Washington, and more particularly described as follows,
to-wit:

Portion of alley approximately 105 feet north of 4th Street
N.E. and approximately 85.5 feet east of "E" Street N.E.
described as follows:
.Beginning at the northwest corner of Lot 3, Block 2, Langes
First Addition as recorded in Vol 25 of Plats, page 36,
thence east g2+ feet to the northeast corner of Lot 4,
Block 2, then ~orth along the east line of Langes First
Addition to the northeast corner of said Addition, thence
west approximately 92 feet along said north line to a point
of intersection with a line produced northerly along the
west line of Lot 3, Block 2, tanges First Addition, thence
south to the POB, situated in Section 18, Twp 21 N, R 5 E,
W.M., City of Auburn, County of King, State of Washington.
be and the same is hereby vacated, and the property lying in said portion of a
certain alley right-of-way described hereinabove, shall be returned and
belong to the abutting property owners, of said portion of a certain alley
right-of-way located on that portion of land designated as a public alley
located approximately 105 feet north of Fourth Street Northeast and approxima-
tely 85.5 feet east of "E" Street Northeast, lying within the corporate limits
of the City of Auburn, Washington.
Section 2. That the request for vacation of alley right-of-way be
granted subject to a public utility easement over, across, upon and underneath
that portion of said vacated alley as described hereinabove, for ingress and
egress for the purpose of installing and maintaining public utilities for
power, telephone, gas, televison cable, water, sanitary sewer, and storm
drainage.
Section 3. Upon the payment to the City Finance Department the amount of
$1,161.52, for one-half the assessed value of the above described real property
and upon the passage, approval and publication of this Ordinance, the Legal
Department for the City of Auburn shall cause this Ordinance to be recorded in
the office of the King County Auditor.

Section 4. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.
Section 5. This Ordinance shall take effect and be in force five {5) days
from and after its passage, approval and publication, as provided by law.
