AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, pRbVID~G
FOR THE REZONING OF PROPERTY LOCATED ON THE EAST SIDE OF "B"
STREET N.W. IN THE 4400 BLOCK, WITHIN THE CITY OF AUBURN,
WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM
COUNTY SR (SUBURBAN RESIDENTIAL) AND GENERAL TO M-1 (LIGHT
INDUSTRIAL) .
WHEREAS, Application No. 34-88 has been submitted to
the Council of the City of Auburn, Washington, by FRANK and
DICK MIYAGISHIMA, requesting the rezoning of the real
property hereinafter described in section 2 of the
Ordinance, which application was dated September 29, 1988;
and,
WHEREAS, said request above referred to, was referred
to the Hearing Examiner for study and public hearing
thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the
Council Chambers of the Auburn City Hall, on December 20,
1988, at the conclusion of which the Hearing Examiner
recommended the approval of the rezoning of said property
based upon the following Findings of Fact and Conclusions,
to-wit:

FINDINGS OF FACT
1. The applicants, Frank and Dick Miyagishima, request a
rezone of a 13.09 acre parcel from County Suburban
Residential and General zoning to Auburn's M-1, Light
Industrial zoning classification.
2. The subject property is located on the east side of "B"
street N.W. in unincorporated King County. However,
the owners have simultaneously herewith filed an
application to have the property annexed to the City of
Auburn.
3. The subject site is designated for Light Industrial
uses in the city of Auburn Comprehensive Plan and
currently has an existing single family home located on
it with the rest of the property being vacant.
4. state law permits a rezone application to be considered
although the property is not yet a part of the city of
Auburn.
5. Existing zoning and land uses in the vicinity include
single family land located outside of the city of
Auburn and within King County to the north and east and
M-1, Light Industrial land to the south and west.
However, it should be pointed out that land on
virtually all sides of the subject site is designated
for light industrial uses in the city's Comprehensive
Plan.
6. Water and sewer is available to serve the subject site
although both of these utilities will need to be
extended.
7. The site has access to liB" street N.W. which is
designed and intended for use as an arterial. However,
the portion of "B" street which the site abuts is not
yet constructed to the City's arterial standards.
Accordingly, in conjunction with the development of the
site the abutting portion of liB" street will need to be
constructed to City standards.

1 8 . The evidence establishes that the restrictions placed
upon an M-1 zone within the City of Auburn will limit
2 the amount of activity which can occur outside of the
building and will require a 30 foot setback from
3 adjoining residential areas including unincorporated
• County lands.

9 . The staff report, with its recommendation of
5 conditional approval, is incorporated herein by
reference as though set forth in full.

7 CONCLUSIONS OF LAW
1. The rezone as proposed complies with the goals and
8 policies of the City of Auburn Comprehensive Plan.

CO 9 2 . The rezone is also compatible with adjacent land uses

For each of the above referenced reasons, the

0 recommendation of the Hearing Examiner to the Auburn City

CID Council on the requested rezone is approved.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. The above cited Hearing Examiner's Findings

of Fact and Conclusions, are herewith incorporated in this
17
Ordinance.

19 Section 2 . The following legally described property
located on the east side of "B" Street N.W. in the 4400
20
21 block, situate in the City of Auburn, County of King, State
22 of Washington, be and the same is hereby rezoned from County

section 3. Prior to development of the site, 15 feet
of additional right-of-way will be dedicated by Statutory
Warranty Deed on that portion of "B" Street that abuts the
proposal and will be constructed to arterial standards.
utilities will also need to be extended to serve an
industrial development as required by the city of Auburn.
section 4. Any building or parking area which
encroaches within 50 feet of the adjoining unincorporated
County shall be separated by a 10 foot width of Type I
landscaping.
section 5. Upon the passage, approval and publication
of this Ordinance as provided by law, the City Clerk of the
city of Auburn shall cause this Ordinance to be recorded in
the office of the King County Auditor.
section 6. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.

section 7. This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
