HomeMy WebLinkAbout4330I ,...~::;.F.:..:~...'...C:.',~O~ORDINANCE NO. 4 3 3 0 2 '..'~ ~,/{..:~.~. 3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF STREET RIGHT-OF-WAY, SITUATED ON THAT PORTION I LAND DESIGNATED AS A PUBLIC STREET LOCATED NORTH OF 30TH STREET ~.~., WITHIN THE CITY OF AUBURN, WASHINGTON. 5 6 WHEREAS, the City Council of the City of Auburn, Washington, have passed 7 and adopted Resolution No. 1907, resolving that a public hearing shall be 8 had for the purpose of determining whether or not the heroinafter described 9 as E Street located on that portion of land designated as a public street 10 right of way from 30th Street N.E. to 35th Street N.E,, within the corporate 11 limits of the City of Auburn shall be vacated, said portion to be vacated 12 being heroinafter legally described in attached Exhibit "A" of this 13 Ordinance; and ]l WHEREAS, notice of public hearing to vacate the right of way legally ]5 described in attached Exhibit "A" was given in the time and manner provided 16 by law, giving notice that the hearing on said Resolution No, 1907 was held 17 on the 21st day of November, 1988, at 7:30 P.M. in the Council Chambers of 18 the Auburn City Hall; and 19 WHEREAS, the Auburn City Council at their regular meeting of November 21, 20 1988, having deemed that the petition for vacation was proper and that no 2] vested rights would be affected by the same. 22 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO 23 ORDAIN AS FOLLOWS: 2t 25 Ordinance No. 4330 26 Page One 2115189 i Section 1. The legal description of the street right of way to be vacated is as described in the attached Exhibit "A", by reference incor- 3 porated in this Ordinance, is situated on that portion of "E" Street designated as a public street right of way located between 30th Street N.E. 5 and 35th Street N.E., within the City of Auburn, Washington, be and the same is hereby vacated, and the property lying in said portion of a certain street right-of-way described hereinabove, shall be returned and belong to 8 those persons entitled to receive the property in accordance with the law' Section 2. The City hereby reserves an easement for access and for the 10 construction, repair and maintenance of public utilities and services. The 11 property reserved for an easement is legally described in the attached 12 Exhibit "B", by reference incorporated in this Ordinance. 13 Section 3. Upon the passage, approval and publication of this Ordinance, 14 the Legal Department for the City of Auburn shall cause this Ordinance to be 15 recorded in the office of the King County Auditor. 16 Section 4. The Mayor is hereby authorized to implement such administra- 17 tire procedures as may be necessary to carry out the directions of this 18 legislation. 19 20 21 25 .....
