ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE VACATION OF A STREET RIGHT OF WAY
KNOWN 18TH STREET N.E.,IN THE 1000 BLOCK, WITHIN THE CITY OF
AUBURN, WASHINGTON, AND RETAINING A UTILITY EASEMENT AND AN
EMERGENCY VEHICLE ACCESS EASEMENT FOR THE CITY.
WHEREAS, a petition has been filed by the owners of two-
thirds or more of the property abutting the portion of right
of way requested to be vacated; and
WHEREAS, the statute requires that the City Council
schedule a public hearing when a valid petition is filed with
the City; and
WHEREAS, the public hearing was held on December 18, 1989
before the City Council;
NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The street right of way to be vacated is
located on that portion of land known as 18th Street N.E., in
the 1000 block, legally described as follows:
THAT PORTION OF THE SW 1/4 OF THE NE 1./4 OF
SECTION 7, T 21 N, R 5 E, W.M., IN THE CITY OF
AUBURN, KING COUNTY, WASHINGTON BEING DESCRIBED
AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF LOT 2 OF
THE CITY OF AUBURN SHORT PLAT NO. SP-9-83 AS
RECORDED UNDER AUDITOR'S FILE NO. 8310261128
(FORMERLY KNOWN AS THE NORTHEAST CORNER OF LOT

EASTERLY ALONG THE EASTERLY PROJECTION OF THE
NORTH LINE OF SAID PLAT OF MEADOW BROOKE
ESTATES A DISTANCE OF 41.47 FEET, TO THE
WESTERLY MOST LINE OF VALLEY AIRE TOWI~OUSES
CONDOMINIUMS AS RECORDED IN VOLUME 26 OF

PROJECTION THEREOF, A DISTANCE OF 155.08 FEET,
TO THE EASTERLY PROJECTION OF THE NORTH MARGIN
OF 18TH STREET NE AS DELINEATED ON SAID PLAT OF
MEADOW BROOKE ESTATES; THENCE WESTERLY ALONG
SAID LINE A DISTANCE OF 40.83 FEET, TO THE
SOUTHEAST CORNER OF SAID LOT 2 OF SP-9-83;
THENCE NORTHERLY ALONG THE EAST LINE OF' SAID
LOT A DISTANCE OF 155.31 FEET, TO THE TRUE
POINT OF BEGINNING.
SUBJECT TO A PUBLIC UTILITIES AND EMERGENCY
VEHICLE EASEMENT OVER THE EAST 20 FEET OF THE
WEST 25 FEET THEREOF.
be and the same is hereby vacated, and the property lying in
said portion of a certain street right of way described
hereinabove, shall be returned and belong to those persons
entitled to receive the property in accordance with the law.
Section 2. The City hereby retains an easement for the
construction, repair and maintenance of utilities over,
across, upon and underneath the property described in Section
1 of this Ordinance and a 20 foot emergency vehicle access
easement across and upon the property described in Section 1
of this Ordinance.

Section 3. Upon the passage, approval and ~,ublication
of this Ordinance, the City Clerk for the City of Auburn shall
cause this Ordinance to be recorded in the office of the King
County Auditor.
Section 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directives of this legislation.
