WASHINGTON, AMENDING SECTION 13.36.110
ENTITLED "RATES AND CHARGES" OF CHAPTER
SYSTEMS" TO ALLOW A BASIC RATE DISCOUNT

WHEREAS, Section 13.36.110 governs the requirements for

rates charged by the Cable Industry in the City of Auburn; and
WHEREAS, it is in the public interest that a discount in
basic cable service be provided to low-income senior citizens

of Auburn;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Purnose. The purpose of this Ordinance is to
amend the Auburn City Code to provide for a discount to low-
income senior citizens for basic cable service.
Section 2. Amendment. Section 13.36.110 of the Auburn

City Code entitled "Rates and Changes", which is contained in
Chapter 13.36 entitled "CATV Systems", is hereby amended to
provide a discount to low-income senior citizens for basic
cable service. A copy of said amendment is attached hereto as
Exhibit "A" and made a part hereof as though set forth in full
herein.

Section 3. Authoritv. The Mayor is hereby authorized to

implement such administrative procedures as may be necessary to
carry out the directives of this legislation.

Section 4. Severability. If any provision of this
6
Ordinance is held invalid for any reason, the remaining
7
provisions of the Ordinance shall remain in force and effect.
8

effective within five (5) days from and after its passage,
approval and publication, as provided by law.

A.
The grantee shall charge no more for basic
services in the city than is charged by the
cable industry in surrounding areas unless
the grantee can show cause why such rates
should be higher.

B.
The grantee shall keep on file with the
city and the office a copy of the current
rates and charges for all services offered.
The grantee shall give subscribers, the
office and the city sixty days' written
notice of any changes in subscriber rates
and charges. The proposed new rates shall
become effective sixty days after receipt
of such notice by the city «~~i%i~y»
municipal services committee unless the
«~~i%i~y» municipal services committee
calls a public hearing on the new rates and
makes a recommendation to the city council.
The purpose of such a public hearing shall
be to determine if the proposed new rates
are just and reasonable.

D.
The arantee shall aaree to charae a
discount rate for basic cable service to
low-income senior citizens in the city of
Auburn. The amount of the discount rate
will equal 30% of the basic retail rate
plus any applicable taxes. The arantee
aarees that the qualifications for
determinina low-income senior citizen
status shall be the same parameters used
for the utility rate discount as provided
in Auburn City Code section l3.24.0l0.
which is based upon the criteria of the
U. S. Department of Housina and Urban
Development.
