AN ORDINANCE OF THE CITY COUNCIL OF THE Crry OF AUBURN,
WASHINGTON, AMENDING ORDINANCE NO. 3297 (PASSED JULY 21,
1978) (AMENDED BY ORDINANCE NO. 3325, PASSED OCjmBER 16, 1978
AND REFERRED TO IN RESOLUTION NO. 1684, PASSED MÞ.Y 19, 1986 AND
SUBSEQUENT AMENDMENTS) TO AMEND THE CABLE COMMUNICATIONS
FRANCHISE TO PROVIDE FOR A DISCOUNT FOR BASIC CABLE SERVICE FOR
LOW-INCOME SENIOR CITIZENS.

WHEREAS, it is in the public interest that a discount rate

for basic cable service be allowed to low-income senior
9
citizens;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. PurDose. The purpose of this Ordinance is to
amend the franchise originally granted to Clearview Cable of
Enumclaw, Inc. and subsequently assigned to TCI Cable, Inc. to
provide for a discount in the basic cable service rate for low

income senior citizens.

Section 2. Amendment. Ordinance No. 3297 (passed July
21, 1978), as subsequently amended by Ordinance 3325 (passed
October 16, 1978) and as referred to in Resolution No. 1684
(passed May 19, 1986) and sUbsequent amendments is amended to
add a new Section VIII to the franchise as follows:

VIII. RATES AND CHARGES.

Rates and charges shall comply with the
requirements of state and federal la~1 and
wi th the requirements of City ordinanc,a and
subsequent amendments thereto. The
Ordinance amendment providing for a
discount in basic service charge for low-
income senior citizens shall apply tel the
remainder of the term of this franchis,a and
shall commence upon the City's filing of
the applicable percentage with the City
Clerk and upon the grantees' issuance of
written notice of the discount to the
subscribers, as required by Se(~tion
13.36.110 (c) of the Auburn City Code. The
parties agree and understand that the
discount in the monthly basic service
charge for low-income senior citizens will
equal 30% of the basic retail rate plus any
applicable taxes. The qualifications for
determining low income eligibility shall be
based upon the provisions of Auburn City
Code section 13.24.020 which is based upon
the criteria of the U. S. Departmen't: of
Housing and Urban Development.

Section 3. Severability. If any provision of this
Ordinance is held invalid for any reason, the remaining
provisions of the Ordinance shall remain in force, and effect.
Section 4. Effective Date. This Ordinance shall become
effective within five (5) days from and after its passage,
approval and pUblication, as provided by law.
Section s. Authoritv. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to
carry out the directives of this legislation.

The undersigned Grantee, TCI Cable, Inc. of Washington,
