HomeMy WebLinkAbout4542 19 20 21 22 23 24 25 26 1 2 3 ORDINANCB NO. .. 5 .. 2 4 AN ORDINANCE OF THE CITY OF AUBURN , WASHING~~ON , AMENDING SECTION 3 OF ORDINANCE NO. 4533 AND AUTHORIZING EXECUTION OF AN INTERLOCAL AGREEMENT FOR ESTABLISHMENT OF' THE GROWTH MANAGEMENT PLANNING COUNCIL OF KING COUNTY TO DEVELOP COUNTYWIDE PLANNING POLICIES. 5 6 7 WHEREAS, City of Auburn Ordinance No. 4533 authorized 8 execution of an Interlocal Agreement for establishment of the Growth Management Planning Council of King Coun1:y to develop countywide planning policies; and WHEREAS, pursuant to the execution of said Agreement, representatives of suburban cities, King County and the City of Seattle have agreed to an amendment to Section 3 of said 9 10 11 12 13 14 Agreement; 15 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 16 WASHINGTON, ORDAINS AS FOLLOWS: 17 18 Section 1. The Mayor and City Clerk of the city of Auburn are hereby authorized to execute, for and on behalf of the city of Auburn, an Agreement with King County and the cities and towns within King County which is at1:ached hereto as Exhibit "A" and incorporated herein. Execution of the Agreement ëLuthorized in section 1 hereof, and any other action taken consistent with 7 the Agreement but prior to the effective date of this 8 Ordinance, are hereby ratified and confirmed. 9 10 Section 3. WHEREAS RESHB 1025 adopted in 1991 requires that, through a process agreed to by the County, Seattle, and Suburban Cities, the legislative authority of the County adopt a county-wide planning policy hy July I, 1992, and WHEREAS the County, Seattle, and Suburban Cities have developed a collaborative process to produce the county-wide planning policy, and WHEREAS this agreement is authórized by the Interlocal Agreement Act, RCW 39.34, NOW, THEREFORE, the parties mutually agree as follows: 1. Definitions. a. Suburban Cities: Cities and towns in King County other than the City of Seattle. b. Countv-wide Dlannin2 Dolicv (CPP): The written policy statement or statements used solely for establishing a county-wide framework from which County, Seattle, and Suburban City compreh'msive plans are developed and adopted, thus promoting comprehensive plans which are consistent as required by RCW 36.70A.l00. 2. Establishment of the Growth Mana2ement Plannin2 Council and staff. In order to establish the Growth Management Planning Council and provide staff, the parties shall designate the following elected official members and staff, by January 1, 1992. To the extent possible, the parties' designees shall have a broad geographic representation. a. MembershiD for the Growth Mana2ement Plannin2 Council (GMPC). I) Seattle shall designate three members to exercise three votes; 2) Suburban Cities shall designate six members to exercise three votes; 3) King County shall designate six members, one of whom will be the King County Executive, to exercise six votes. b. Staff to the GMPC. 1) Each party shall designate staff to form an inteIjurisdictional team to provide staff to the GMPC. The County shall have designated staff of the King County Council and designated staff of the King County Executive. The staff designated by the Executive shall serve as lead for the inteIjurisdic:tional team. matters. 2) The GMPC shall select a coordinator specifically to handle its administrativ" and procedural 3. Following a public hearing, the King County Council shall adopt a CCP and circulate it for ratification. The CCP shall be deelI.ed ratified ------------------------------ Ordinance No. 4542 Exhibit "A" Page 1 when approved by at least thirty percent (30%) of the city and county governments representing seventy percent (70 %) of the population of King County. 4. Function and authority of GMPC. a. The GMPC ahall recommend to the King County Council the county-wide planning policy in a form and with content to comply with applicable State law. The recommended planning policy from the GMPC shall address issues and concerns obtained from review and comment during its public review process. At a minimum, the CPP ahall address the following: policies to implement RCW 36.70A.ll0; policies for promotion of contiguous and orderly development and provision of urban services to such development; policies for siting public capital facilities of a county-wide or state-wide nature; policies for county-wide transportation facilities and strategies; policies that consider the need for affordable housing, such as housing for all economic segments of the population and parameter for its distribution; policies for joint county and city planning within urban growth areas; policies for county-wide economic development and employment; and an analysis of the fiscal impact. b. The GMPC shall devise and the parties ahall comply with a locally based conflict resolution process which will be directed at conflicts which may arise during the development of the cpp by the GMPC. c. The GMPC shall devise and the parties ahall comply with a process to amend the CJ>P that is adopted and ratified. S. Fundin2 for staff of the GMPC. The parties recognize that under a separate agreement which allocates the State Growth Management Act grant dollars among King County, Seattle, and Suburban Cities :funds are set aside for the development of the CPP. 6. Duration. This agreement shall become effective January I, 1992 and shall remain in force Imd effect until completion of the designated duties of the GMPC or July 1, 1992, whichever occurs first, unless extended by mutual agreement of the parties, provided that a party may withdraw from this agreement with sixty (60) days notice to the County. 7. Amendments. This agreement may be amended by mutual written agreement of the parties. 8. Entire a2reement. The parties agree that this agreement is the complete expression of the terms hereto and any oral representations or understandings not incorporated herein are excluded. The parties rec:ognize that time is of the essence in the performance of the provisions of this agreement. 9. State relationshiD. A copy of this agreement shall be filed with the Washington State Department of Community Development.
