WA 98001 . .~'~ r~"~' ¡ '.,: L '> " _L ,_:J\; \/ - '...., ORDINANCE NO. 4 5 5 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN , WASHINGTON, APPROVING THE VACATION OF A STREET RIGHT OF WAY KNOWN AS 8TH STREET SOUTHEAST BETWEEN "D" STREET SOUTHEAST AND AUBURN WAY SOUTH, WITHIN THE CITY OF AUBURN, WASHINGTON, AND RETAINING EASEMENT FOR STREET AND UTILITY PURPOSES FOR THE CITY. WHEREAS, Petition No. VACOOOl-9l has been filed by the owners of two-thirds or more of the property abutting the portion of right of way requested to be vacated; and WHEREAS, the statute requires that the City Council schedule a public hearing when a valid petition is filed with the City; and WHEREAS, the pUblic hearing was held on February 18, 1992 before the City Council at which time the matter was referred to the Public Works Committee for a report thereon; and WHEREAS, on March 2, 1992 the Public Works Committee recommended approval of the street vacation and the City Council did approve such street vacation. NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The street right of way located on that portion of land known as 8th Street southeast between "D" Street Southeast and Auburn Way South, within the city of Auburn, Washington, legally described as follows: ----------_.._------~----_. .------ Ordinance No. 4550 March 5, 1992 Page 1 t'!1'fH J;.¡;; ;,':!: :::\}D:J31~lNrD~ JND ~!í JO:¿O=[! 88tQ-S2€C,2f. --"'--'-~~~ ~-~ -T---- --~ 1 2 3 4 5 6 7 8 9 10 11 (l) 12 ClJ ~ 13 0 '" 14 N '" 15 0 N 16 (1') 17 18 19 20 21 22 23 24 25 26 That portion of 8th street Southeast in Gover~ment Lot 1 and Government Lot 5 of Section 19, Township 21 North, Range 5 East, W.M., in King County, Washington, described as follows: Commencing at the Northeast corner of said Government Lot 1; thence south 0 . 47' 40" west along the east line of said Lot 1, 115.88 feet to the northerly margin of 8th Street Southeast and the POINT OF BEGINNING; thence north 89°19'39" east along said margin 80.95 feet to the westerly edge of sidewalk also being the westerly as-built right of way for "D" Street Southeast; thence south 18°26'20" west along said sidewalk 20.04 feet to a point of curvature from which the radius point bears north 69°17'55" west a distance of 36.72 feet; thence southwesterly along said sidewalk and curve to the right an arc distance of 30.42 feet through a central angle of 47"27'08" to a point of compound curvature also being the northeasterly right of way of Primary State Highway No. 5 and from which a radius point bears north 59°40'08" west a distance of 528.00 feet; thence northwesterly along said right of way an arc distance of 69.80 feet through a central angle of 7" 34' 27" to the northerly margin of said 8th Street Southeast; thence north 89°19'39" east along said margin 3.82 feet to the POINT OF BEGINNING. The ci ty hereby retains an easement for street purposes for the construction, repair and maintenance of all street facilities over, across, upon and underneath the property described in Section 1 of this Ordinance except for the north eight feet. Section 3. The City hereby retains a utility easement for the construction, repair and maintenance of all utilities over, across, upon, and underneath the property described in Section 1 of this Ordinance. section 4. The Owner shall provide and maintain landscaping features within the portion of the street proposed to be vacated. The location, type and nature of the landscaping shall be agreed to by both the City and the owner prior to this vacation ordinance becoming effective. Section 5. Upon the passage, approval and publication of this Ordinance, the City Clerk for the City of Auburn shall cause this Ordinance to be recorded in the office of the King county Auditor. section 6.
