WHEREAS, Application No. CUP0008-91 dated July 29, 1991, together with site plans therefore, has been submitted to the City of Auburn, Washington, by the Church of Jesus Christ of Latter Day Saints NW Area requesting a Conditional Use Permit to allow construction of a building to be used as a religious educational classroom for high school students to be located at 331 4th Street N.E. in an R-4 (Multiple Family Residential District) zone within the City of Auburn, Washington, hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a pUblic hearing to consider said petition in the Council Chambers of the Auburn City Hall, on February 19, 1992, at the conclusion of which the Hearing Examiner recommended the approval of the issuance of a Conditional Use Permit to allow construction of a building to be used as a religious h_.-_________________h__.______ Ordinance No. 4551 March 10, 1992 Page 1 -- ---_._".~._------------~----_._.__.- .'.- -~--.._._._--- 1 2 3 4 5 6 7 8 9 10 ("') 11 a) (") 12 - N - 13 LD 0 14 N (]" 15 16 17 18 19 20 21 22 23 24 25 26 educational classroom for high school students to be located at 331 4th street N.E. in an R-4 (Multiple Family Residential District) zone based upon the following Findings of Fact and Conclusions, to-wit: FINDINGS OF FACT 1. The applicant, the Church Saints NW Area, through Associates Inc., request a Day and of Jesus Christ of Latter its agent David Evens Conditional Use Permit. 2. The proposal would be to allow the construction building to be used for a classroom seminary religious educational classroom facility for high students. of a to a school 3. The subject property is 11,812 square feet in size and is located at 331 4th Street N.E. in Auburn. 4. The subject property Residential District, home and a vacant lot. is zoned R-4, Multiple Family and is currently a single family 5. The Comprehensive Plan designates the subject site for high density residential uses. 6. Currently, land in all directions is zoned for multiple family residential uses and designated in the Comprehensive Plan for similar uses. However, to date the existing land use in the vicinity is still single family. 7. The proposal is located approximately 800 feet away from the Auburn High School and is on the same street as the high school. It is anticipated that students who attend classes at the LDS facility will be walking to same from the high school. 8. The facility will contain one classroom and there will be one teacher who will conduct approximately 5-6 classes each day. It is estimated that there will be between 10- 20 students in each class. 10. The existing single family home on the lot will be removed and replaced with the 1800 square foot building. The building will be 15 feet high and will be of brick construction very similar to a single family home. 11. The site plan illustrates a substantial amount of landscaping together with parking in the rear yard accessible from the alley. The site plan also appears to anticipate an expansion at a future date. Any expansion would require a future conditional use permit. 12. Multiple family uses in the form of a 4-plex will be permitted on the property. 13. The staff report with its recommendation of conditional approval, is incorporated herein by reference as though set forth in full. CONCLUSIONS OF LAW 1. The Zoning Code sets forth a series of criteria which must be established by the evidence before a Conditional Use Permit can be granted. The first of these criteria is that the use will have no more of an adverse effect on the heal th, safety, or comfort of persons living or working in the area than would any use generally permitted in the district. The size, construction, and amenities proposed for the building are more consistent with existing neighborhood uses than a 4-plex which could be built on the site. 2. The proposal complies with the goals, policies, and objectives of the Comprehensive Plan and with the zoning Ordinance. 3. The proposal will not adversely affect the pUblic infrastructure. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn city Council on this Conditional Use Permit to allow construction of a building to be used as a religious educational classroom for high school students to be located at 331 4th street N.E. is approved and affirmed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. A Conditional Use Permit is hereby approved to allow construction of a building to be used as a religious educational classroom for high school students to be located at 331 4th Street N.E. in an R-1 (Multiple Family Residential District) zone, situate in the City of Auburn, county of King, State of Washington, and is legally described as follows: Lots 5 and 6 and th eat 12.5 feet of Lot 7, Block A, Arthur C. The expansion area as illustrated on the site plan will require an additional conditional use permit to be processed in order to allow for the proposed expansion. Section 4. Upon the passage, approval and pUblication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. section s. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6.
