AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF TWO 4-PLEXES
ON PROPERTY LOCATED AT 2025 "M" STREET N.E. IN AN R-3 (TWO
FAMILY DUPLEX RESIDENTIAL DISTRICT) ZONE, WITHIN THE CITY OF
AUBURN, WASHINGTON.
WHEREAS, Application No. CUP0009-91 dated July 29, 1991,
together with site plans therefore, has been submitted to the
City of Auburn, Washington, by CYNDI HUANG requesting a
Conditional Use Permit to allow construction of two 4-plexes
to be located at 2025 "M" Northeast in an R-3 (Two Family
Duplex Residential District) zone within the Cit:y of Auburn,
Washington, hereinafter described in section 2 of the
Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the council
Chambers of the Auburn City Hall, on February 19, 1992, at the
conclusion of which the Hearing Examiner recommended the
approval of the issuance of a Conditional Use Pe1~it to allow

N. E. in an R-3 (Two Family Duplex Residential District) zone
based upon the following Findings of Fact and Conclusions, to-
wit:
FINDINGS OF FACT
1.

2. The subject property is located at 2025 "M'" street N.E.
and is zoned R-3, Two Family Duplex Residential District.
The Comprehensive Plan designates the subj ect site for
moderate density residential uses.
3. Land in all directions is similarly zoned and has the
same Comprehensive Plan land use designatic)n. Land to
the north and south is developed with duplexes while
there is a mUlti-family development to t,he west and
single family uses to the east.
4. The construction of 4-plexes is permitted in the R-3 zone
subject to the issuance of a conditional use permit.
5. The subject property is 90,160 square feet in size and
contains four 4-p1exes. The R-3 zone r,equires 3600
square feet of lot area per unit and therefore there is
sufficient property to accommodate the two new 4-plexes
as proposed.
6. The two new 4-plexes will be provided acc,~ss from the
existing roadway and a 65 foot diameter turnaround for
fire trucks will be constructed.

7. The setbacks for the 4-plexes are 35 and 10 feet
respectively from the north property line. As a result
of the configuration of the lot and its frontage on "M"
street, the north property line is considered a side yard
and a 5 foot setback is all that is required.
8. The site plan does not clearly illustrate the required
off-street parking, however, the size of the site is more
than sufficient to provide the required parking.
9. The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though
set forth in full.
CONCLUSIONS OF LAW

2. The first of these criteria is that the use will have no
more of an adverse affect on the health" safety, or
comfort of persons living or working in the area than
would a use that is generally permitted in the district.
Currently, the zoning will permit four duplexes to be
constructed on the site. This proposal does not increase
the number of dwelling units but instead permits more
units per structure. The first criteria is established
by the evidence.
3. The proposal is designated on the Comprehemdve Plan map
for moderate density residential uses. Four-plexes are
therefore appropriate in this designation.
4. The site plan indicates that the proposal is able to meet
all requirements of the Zoning Ordinance and the
buildings are consistent with other construction in the
vicinity.
5. There is no evidence to suggest that the proposal will
adversely affect the pUblic infrastructure.

For each of the
above
referenced
reasons,
the
recommendation of the Hearing Examiner to the Auburn City
Council on this Conditional Use Permit to allow construction
of two 4-plexes on property located at 2020 "M" street N.E. is
approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
section 1.
The above cited Hearing Examin'~r's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.
Section 2. A Conditional Use Permit is hereby approved
to allow construction of two 4-plexes to be located at 2025
"M" Street N. E. in an R-3 (Two Family Duplex Residential
District) zone, situate in the City of Auburn, County of King,
State of Washington, and is legally described as follows:

Seotion 3. The north and east property lines, of the two
new 4-plexes, shall be landscaped with a 5 foot 1i17idth of Type

Section 4.
The site plan shall be amemded by the
applicant and approved by the Planning Direct:or prior to
applying for building permits.

illustrate all Zoning Code requirements.

this Ordinance as provided by law, the city Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.

such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 7.
This Ordinance shall take effec~t and be in
force five days from and after its passage, approval and
publication as provided by law.
