IN THE 200-300 BLOCKS IN AN R-3 (TWO FAMILY DUPLEX RESIDENTIAL DISTRICT) ZONE, WITHIN THE CITY OF AUBURN, WASHINGTON. 4 5 6 r ~~ WHEREAS, Application No. CUP0001-92 dated January 6, 1992 7 together with site plans therefore, has been submitted to the city of Auburn, Washington, by NGON WONG, ET AL, requesting a Conditional Use Permit to allow construction of four 4-plexes and one triplex on property located on the south side of 21st Street S.E. in an R-3 (Two Family Duplex Residential District) zone within the City of Auburn, Washington, hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on April 21, 1992, at the conclusion of which the Hearing Examiner recommended the approval of the issuance of a Conditional Use Permit to allow construction of four 4-plexes and one triplex to be located on the south side of 21st Street S.E. in the 200-300 block in an R-3 (Two Family Duplex Residential District) zone based upon the following Findings of Fact and Conclusions, to-wit: 00'11 Nd çoo SGtIO:J3ä A1III1O:J 9Nn !IV DlJIIJaI80 9a~O-ZI9IJa6 ____-.__n______-.___________u_ Ordinance No. 4563 May 7, 1992 Page 1 _._~.~~- ..----- ..~--------~ 1 2 3 4 5 6 7 8 9 10 tÞ 11 N N 12 0 N 13 ... r.Þ 14 0 N 15 Ø) 16 17 18 19 20 21 22 23 24 25 26 FINDINGS OF FACT 1. The applicant, Ngon Wong, et aI, applies for a Conditional Use Permit to allow the construction of 4 four-plexes and 1 triplex. 2. The subject property is located on the south side of 21st street S.E. between the 200-300 blocks and is currently zoned R-3, Two-Family Duplex Residential District. 3. Surrounding zoning and land uses in the vicinity include R-3, duplexes, to the north; R-3, outdoor use, to the south; R-3, commercial, to the east; and C-3, single family home, to the west. Land to the west of the subject site, although still developed with a single family home, is zoned and designated for heavy commercial uses in the City's Comprehensive Plan. 4. The Zoning Ordinance requires 3600 square feet of land per each unit and the ordinance further limits the number of units per structure to a maximum of four. Currently, the site is divided into 2 parcels. The smaller parcel which is 11,522 square feet in size contains a single family home which the applicant proposes to demolish. The larger parcel which is 57,933 square feet in size has received preliminary approval for a 4 lot short plat. 5. The site plan illustrates the construction of 4 four- plexes and 1 triplex. This development is therefore subject to the requirements of a conditional use permit. 6. The short plat will be provided with access from a 95 foot long private cUl-de-sac. Each lot within the short plat together with the existing lot will be provided with access via the cul-de-sac. 7. The proposal is harmonious with the duplexes to the north and will improve the appearance of the area which contains some nonconforming commercial uses. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. A Conditional Use Permit is hereby approved to allow construction of four 4-plexes and one triplex to be located on the south side of 21st Street S.E. in an R-3 (Two Family Duplex Residential District) zone, situate! in the City of Auburn, County of King, State of Washington, and is legally described as follows: Lot 2, Truesens First Addition to the City of Auburn, Vol. 29, Page 46 of Plats, King County, WA. Section 3. The proposal be developed consis1:ent with the requirements of the short plat #SPL0006-91. Section 4. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the city of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. Section 5. This Ordinance shall take effect and be in force five days from and after its passage, approval and pUblication as provided by law.
