AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW ESTABLISHMENT OF A 3,760
SQUARE FOOT AUTOMOBILE DISMANTLING SHOP ON PROPEHTY LOCATED AT
SUITE #10, ONE 30TH STREET N.W. IN A M-2 (HEAVY INDUSTRIAL)
ZONE, WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application No. CUP0002-92 dated l~arch 9, 1992
together with site plans therefore, has been submitted to the
City of Auburn, Washington, by JAMES I. HART, requesting a
Conditional Use Permit to allow the establishment of a 3,760
square foot automobile dismantling shop on property located at
suite #10, One 30th Street N.W. in a M-2 (Heavy Industrial)
zone within the City of Auburn, Washington, hereinafter
described in Section 2 of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and pUblic hearing thereon; and
WHEREAS, the Hearing Examiner, based upon Eitaff review,
held a public hearing to consider said petition in the Council
Chambers of the AUburn City Hall, on April 21, 1992, at the
conclusion of which the Hearing Examiner rec()mmended the
approval of the issuance of a Conditional Use Permit to allow
the establishment of a 3,760 square foot automobile
dismantling shop on property located at Suite #10, One 30th
Street N.W. in a M-2 (Heavy Industrial) zone based upon the
following Findings of Fact and Conclusions, to-wit,:

FINDINGS OF FACT
1. The applicant, James I. Hart, applies for a Conditional
Use Permit to allow the establishment of an automobile
dismantling shop. The subject property is located within
an existing industrial park.
2. The industrial park is located at One 30th street N.W.
and the applicant proposes to operate his automobile
dismantling shop in #10 which is 3,760 square feet in
size.
3. The subject site is zoned for and utilized for industrial
uses. Similar zoning designations and uses surround the
vicinity although the land to the south is vacant.
4. The M-2, Heavy Industrial zone, permits the use subject
to the issuance of a conditional use permit.
5. There are a number of similar industrial users within the
building.
6. The applicant testified that he would dismantle
automobiles and then wholesale the parts. The work to be
performed by the applicant typically involves dealing
with used and potentially environmentally hazardous
substances such as oil, grease, antifreeze, and
transmission fluids. Conditions should be ei;tablished so
that water quality is not affected and that adjacent
properties are not impacted.
7. There is no indication on the application or the site
plan that there would be any outside use of the building
for either storage or dismantling of cars.
8. The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though
set forth in full.

CONCLUSIONS OF LAW
1. The Zoning Ordinance sets forth a series of criteria
which must be established before a conditional use permit
can be granted.
2. The first of these criteria is that the use will not
adversely affect public health, safety, or comfort. In
this instance, if properly conditioned this heavy
industrial use is similar to other uses allowed in the M-
2, Heavy Industrial zone.
3. The proposal is consistent with the heavy industrial
designation in the Comprehensive Plan and ,::omplies with
the requirements of the Zoning Ordinance.

approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1.
The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.

Section 2.
A Conditional Use Permit is helreby approved
to allow the establishment of a 3,760 square foot automobile
dismantling shop on property located at Suite ;'10, One 30th
street N. W. in a M-2 (Heavy Industrial) zone situate in the
City of Auburn, County of King, state of Washington, and is
legally described as follows:
The north 55 feet of the south 585 feet of
the west 200 feet of H.H. Jones Donation
Claim No. 39, and the north 500 feet of
the south 530 feet of the H.H. Jones
Donation Claim No. 30; situate in the
County of King, State of Washington.
Section 3.
No off-street parking shall be used for
dismantling or storage of vehicles.
If there is any outdoor
storage of vehicles, it must meet all Zoning Code and other
City requirements.

An approved collection system for the used
oil, anti-freeze, transmission fluids, and oth,er potential
contaminants shall be approved by the City Enginee,r.
Section 5. Upon the passage, approval and p\:Lblication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.

The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
