AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN ,
WASHINGTON, ADDING A NEW CHAPTER 15.06 TO THE AUBURN CITY CODE
ENTITLED "UNIFORM CODES ADOPTION" TO PROVIDE: A SEPARATE
CHAPTER FOR ADOPTION OF CERTAIN 1991 UNIFORM CODE:S INCLUDED IN
THE STATE BUILDING CODE AS AMENDED AND ADOPTED BY THE STATE
BUILDING CODE COUNCIL; AND REPEALING AUBURN CITY CODE CHAPTERS
15.10 ENTITLED "ENERGY CODE" , 15.14 ENTIT]['ED "UNIFORM
ADMINISTRATIVE CODE" , AND 15.44 ENTITLED "STANDARDS FOR
BUILDING AND FACILITY ACCESSIBILITY TO TH]~ PHYSICALLY
HANDICAPPED" .

WHEREAS, the city Council has reviewed Auburn City Code
9
Title 15 entitled "Buildings and Construction" and determined
that the Title should be reorganized for better clarity; and
10

WHEREAS, the City of Auburn desires to add a new Auburn
12
City Code Chapter 15.06 entitled "Uniform Codes Adoption"
which adopts certain 1991 Uniform Codes included in the State
Building Code as authorized by RCW 19.27.031 and certain
designated rules contained in the Washington Administrative
Code with specified exceptions and amendments se1: forth fully

in the appropriate chapters of the Auburn City Code as
authorized by RCW 19.27.040.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1.
PURPOSB.
The purposes of tbis Ordinance
are as follows:

A.
Add Chapter 15.06 entitled "Uniform Cedes Adoption"
to the Auburn City Code and to therein adopt the 1991 Uniform
Codes as adopted by the state Building Codle under the

authority of RCW 19.27.031 and certain desi.gnated rules

contained in the Washington Administrative Code ,,'ith specified
exceptions and amendments as set forth fully in the

appropriate chapters of the AUburn City Code as authorized by
RCW 19.27.040.
B.
Repeal Auburn City Code Chapter 15.10 entitled
"Energy Code" as the Washington state Energy Code contained in
Chapter 51-11 of the Washington Administrative Code is
included in the new Chapter 15.06.
C. Repeal Auburn City Code Chapter 15.14 entitled
"Uniform Administrative Code" as the City has adopted

sufficient administrative procedures in Title 15 of the Auburn
City Code.
D.
Repeal Auburn city Code Chapter 15.44 entitled
"standards For Building and Facility Accessibi.1ity To The
Physically Handicapped" as the Washington AdminÍ!¡trative Code
Chapters 51-20 and 51-21 which are included in the new Auburn
City Code Chapter 15.06 contain standards for building and
facility accessibility to the physically handicapped.

Section 2.
REPEAL OF CHAPTER 15.10. Auburn City Code

Chapter 15.10 is hereby repealed in its entir1aty effective

upon the effective date of this Ordinance.

Section 3.
REPEAL OF CHAPTER 15.14. Auburn City Code

Chapter 15.14 is hereby repealed in its entirlaty effective
upon the effective date of this Ordinance.

Section 4.
REPEAL of CHAPTER 15.44. Auburn City Code

Chapter 15.44 is hereby repealed in i ts entir~!ty effective
upon the effective date of this Ordinance.

Section 5.
NEW AUBURN CITY CODE CHAPTER 15.06. There

is hereby added to Title 15 of the Auburn City Code entitled
"Building and Construction" a new Chapter 15.06 entitled
"Uniform Codes Adoption" which is fully set for1:h in Exhibit
"A" attached hereto and incorporated herein.

Section 6.
Constitutionality or Invalid:!..tL..
If any
section, subsection, clause or phrase of this Ordinance is for
any reason held to be invalid or unconstitu'tional, such
invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of
this Ordinance, as it being hereby expressly declared that
this Ordinance and each section, subsection, sen1:ence, clause
and phrase hereof would have been prepared, propc)sed, adopted

and approved and ratified irrespective of the :fact that any
one or more section, subsection, sentence, ClaUSE! or phrase be

declared invalid or unconstitutional.

Section 7. The Mayor is hereby authorized to implement
6
such administrative procedures as may be neCeSf¡ary to carry
7
out the directions of this legislation.

Section 8.
This Ordinance shall take effE,ct and be in
9
force five days from and after its passage, approval and
publication as provided by law.

Conflicts Between Codes.

In case of conflict between codes enumerated in
9
subsections A through G of section 15.06.010, th,a first named
code shall govern over those following; Except 101here, in any
specific case, different sections of these codes specify
10

different materials,
methods of construction or other

requirements, the most restrictive shall govern; and where
14
there is a conflict between a general requirement and a
specific requirement, the specific requirement shall be
applicable.
15.06.030
Exceptions.
The exceptions and amendments to the Uniform Codes
contained in the provisions of Chapter 19.27 RCW shall apply
in cases of conflict with any of the provisions of the
chapters of the Washington Administration COdE' which are
adopted by reference in this chapter.
