WHEREAS, Application MINOOOl-90, dated June 7, 1990, together with site plans therefore, has been submitted to the City of Auburn, Washington, by RAC INVESTMENTS cmd HENDERSON DEVELOPMENT, INC. requesting a Surface Mining Permit to allow the excavation of approximately 125,880 cubic yards of material to accommodate the construction of Lakeland Hills Divisions 9, 10, 12, 13 and 14 consisting of 211 l,ingle family lots within the city of Auburn, Washington, hereinafter described in Section 2 of this Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn city Hall, on April 21, 1992, at 7:00 p.m. , at the conclusion of which the Hearing Examiner recommended approval of a Surface Mining Permit to allow the excavation of approximately 125,880 cubic yards of ,material based upon the following Findings of Fact and Conc:lusions, to- wit: Ordinance No. 4572 May 26, 1992 Page 1 . . 1 2 3 4 5 6 7 8 0 ("") 9 0 0 10 N CO 0 11 C\,J 0'"' 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 PINDINGS OP PACT 1. The applicant, Ken Kinared, Henderson Deve,lopment Inc. applies for a Surface Mining Permit to allow the excavation of approximately 125,880 cubic yards of material. 2. The subject site is approximately 85.8 acreEI in size and is located in the Lakeland Hills area of Auburn. The proposed surface mining permit to allow the ,excavation of earth would accommodate the construction of Divisions 9, 10, 12, 13 and 14 of Lakeland Hills totaling 211 single family lots. 3. The majority of the material to be remo>ved will be utilized on-site within the five divisions. The applicant proposes to use approximately 93,320 cubic yards of fill within the divisions and the remaining 32,560 cubic yards will be exported off-site. 4. The applicant's proposal meets the threshold requirements of the Surface Mining chapter of the Zoning code, Chapter 18.62. Accordingly, a surface mining permit is required. 5. Approximately half of the material to be e,xcavated, or 62,930 cubic yards will be removed from Divisions 9 and 10 which contain 12 acres. Of this amount, 1;he applicant proposes to utilize 25,520 cubic yards of fill within Divisions 9 and 10 and the remaining mateldal will be exported. The applicant proposes to excavate 24,000 cubic yards of material from Division 12 ,.hich is 3.1 acres in size and to use 2500 as fill within the Division. The applicant proposes 1;0 excavate approximately 32,450 cubic yards from Division 13 which is approximately 13.5 acres in size and to u1:ilize all of- the materials so excavated togetherwith a:n additional 32,350 cubic yards of additional fill which will be imported to Di vision 13. The applicant proposes to excavate approximately 6500 cubic yards frollli Division 14 which is 1.9 acres in size and to utilize 500 cubic yards of same within that division. The fill which will be exported off-site, approximately 32,560 cubic yards, will be exported through the applicant's property in pierce County mlt utilizing existing streets within Lakeland Hills as a haul route. 7. The proposal as submitted is capable of meeting all of the applicable requirements and standards 01: the Surface Mining Chapter of the Zoning Code. 8. A number of reports have been completed for the project including a Sub-Surface Exploration, Geologi,~ Hazards and Geotechnical report, among others. The reports outline methods for excavating and filling the si1te and their recommendations are incorporated as a mitigating condition within the Mitigated Determination of Non- Significance issued for this project under Number SEP0047-90R. 9. The property contains some slopes which are 25% or more steeper. Most of these slopes will remain undisturbed and will be protected by the establishment of a native growth protection easement as set forth in the MDNS. The MDNS also requires slope stabilization, a street tree planting program, and plans for landscaping of the individual lots. 10. The Zoning Ordinance requires a storm drainage and erosion control plan for the mining operation and approval of same by the Public Works Department as a condition precedent to excavation. .11. In addition, the Zoning Ordinance requires a Performance Bond to be posted prior to the adoption of 1;he ordinance approving the permit. 12. The Environmental Impact Statement issued on October 5, 1981 for the Lakeland Hills proposed residential community considered development of a larger vacant 443 acre site in the city of Auburn for lo~' and medium density residential development and also included proposed 22 acres of commercial development. Additional environmental review in preparation of a new threshold determination was required by the Washington Administrative Code. As a result of its review, the City of Auburn determined that there was insufficient information in the previously prepared l~nvironmental Ordinance No. 4572 May 26. 1992 Page 3 1 2 3 4 5 6 0 7 ("") 8 0 0 C\J 9 CO 0 C\J 10 0'"' 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Impact statement for a proper analysis of the excavation and traffic impacts of the mining pendt project. Accordingly a Mitigated Determination of Non--Significance was issued containing 23 mitigating conditions. 13. At the time of the Hearing Examiner public hearing, several citizens expressed concern with rElgard to the impact of the excavation on streets in the vicinity. 14. The staff report, with its recommendation 01: conditional approval, is incorporated herein by reference as though set forth in full. CONCLUSIONS OP LAW 1. The Comprehensive operations to create their operation. Plan requires proposed mining usable land as an end result of 2. Although this project meets the requirements the threshold requirements of this surface mining portion of the Zoning Ordinance, the primary purpose of the application is not excavation but rather future single family residential development. 3. Given the overall size of the five Lalceland Hills subdivisions which are being proposed, the Elxcavation of 125,880 cubic yards of earth is not sufficiently large. 4. The application is consistent with the requirements of the Zoning Ordinance regarding surface mines and also promotes the objectives of the Comprehensive Plan policies concerning surface mining. 5. Staff has completed additional environmental review and the MDNS has been issued with a number of appropriate mitigating conditions. 6. The evidence establishes that there are only a few existing single family homes located near the mining area. A 50 foot setback is required by the Zoning Ordinance from other properties in addition 1;0 open space buffers which will be provided. NOW, THEREFORE, THE CITY COUNCIL OF THE CI1'Y OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examinllr's Findings of Conclusions, herewith and approved Fact and are incorporated in this Ordinance. Section 2. A Surface Mining Permit is hereby approved to allow the excavation of approximately 125,880 cubic yards of material to accommodate the construction of La,keland Hills Divisions 9, 10, 12, 13 and 14 consisting of 211 single family lots on property located in Lakeland Hills, situate in the City of Auburn, County of King, State of Washington, and legally described in attached Exhibit "A". Section 3. Material that is excavated shall not be trucked through the existing Lakeland Hills de,velopment in Auburn. Temporary haul routes shall be established through the applicant's property in pierce County. Section 4. The mitigating conditions of t:he Mitigated Declaration of Non-Significance (SEP0047-90R) are incorporated herein by reference. section 6. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk: of the city of Auburn shall cause this Ordinance to be rec':lrded in the office of the King County Auditor. section 7. The Mayor is hereby authorized to implement such administrative procedures as may be necess;:l.ry to carry out the directives of this legislation. section 8.
