WHEREAS, Application No. CUP0004-92 dated April 14, 1992, together with site plans therefore, has been submitted to the city of Auburn, Washington, by AUBURN YO~rH RESOURCES requesting a Conditional Use Permit to allow the addition and modification of an existing residence to be used as a youth group residence to be located at 702 10th Stree1: N.E., in an R-4 (Multi-Family) zone within the City of Auburn, Washington, hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and pUblic hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on May 19, 1992, at the conclusion of which the Hearing Examiner recommended the approval of the issuance of a Conditional Use Permit to allow the addition and modification of an existing resddence to be used as a youth group residence to be located at 702 10th Street N.E., in an R-4 (Multi-Family) zone based upon the following Findings of Fact and Conclusions, to-wilt: Ordinance No. 4573 June 2, 1992 Page 1 1 2 3 4 5 6 7 8 9 10 11 N 12 Cl ("') 13 0 0 N 14 CO 0 15 N Ci' 16 17 18 19 20 21 22 23 24 25 26 FINDINGS 01' FACT 1. The owner/applicant, Auburn Conditional Use Permit to modification of an existing youth group residence. Youth Resourc:es, seeks a allow the addition and residence to be used as a 2. The subject property is located at 702 - 10th street N.E. in AUburn and is on a 10,800 square foot lot. 3. The existing zoning is R-4, multi-family. The house is currently developed with an older single family home which the applicant proposes to remodel and construct a 960 square foot addition. 4. The proposal would be to provide transitional housing for homeless youth ages 18 and over. 5. The applicant has indicated that up to 7 youth will live in the home at anyone time with one to two staff persons who will reside at the residence and provide supervision. 6. The applicant will have rules which will either require the youth to go to school or have a job. ~~his is not a drop-in facility and the persons who reside, in the home must be screened and referred to the hc)me. It is anticipated that the youth will stay at 'the home for between 3 and 12 months. 7. The proposal would provide a transitional environment for persons who desire to start independently but who are currently homeless. living living 8. The evidence establishes that Auburn Youth Resources is a social service agency which has operated in Auburn since 1973. The agency is a family therapy agency with emphasis on youth and youth services. Pro~Jrams include drug and alcohol abuse, sexual abuse, and shelters for runaway youth and other foster care services. 9. Land uses in the vicinity include a condominium development to the east and south and to thl~ north there is a fast food restaurant. To the west there is a saint Vincent DePaul Thrift store. A lot line adjustment is required to remove the interior lot line. 2 3 11. The applicant has indicated that the occupants of the house, except for staff, will not be permitted to have cars. There will also be regulations relating to the number of visitors and the length of their stay. 12. At the time of the public hearing, several citizens of the vicinity express concern with regard to the fact that the neighborhood is frequented by many senior citizens who have worked hard to maintain their homl~s and yards. One witness of an adjacent condominium requested that the project not be approved due to the fact t:hat there is another youth home in the vicinity and that young people frequenting the Kentucky Fried Chicken s:tore in the vicinity have created a problem. 4 5 6 7 8 9 10 11 13. The applicant indicated that no residents over the age of 22 would be permitted to reside at the site. 12 13 14. The staff report, with its recommendation of conditional approval, is incorporated herein by reference as though set forth in full. 14 15 16 CONCLUSIONS 01' LAW 17 1. The City of Auburn Zoning Ordinance sets forth a series of criteria which must be established befon! Conditional Use Permit can be granted. The first of these criteria of the Conditional Use Permit will have no more of an adverse effect on the health, safety, or comfort of persons living or working in the area than would a use permitted outright. The proposal is on the edge of a mUlti-family neighborhood and is located adjacent to commercial activities. Since the lot is landscaped and fenced and is relatively obscured frclm adjoining properties it appears that the use would n01: have a more adverse effect on the area than would any olther multiple family use which would be permitted outright. 18 19 2. The proposal must be in accord with the goals, policies and objectives of the Comprehensive Plan. The proposal can be constructed and maintained so as to be harmonious in design, character, and appearance with the intended character of the general vi,einity. The proposal will remain a single family home l~hich will be appropriate for multiple family uses which adjoin the proposal. 4. There is no indication that the public infrastructure will be adversely effected. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn city council on this Conditional Use Permit to allow the addition and modification of an existing residence to be used as a youth group residence to be located at 702 lOth street N.E., is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CI~~Y OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examinl~r's Findings of Fact and ConClusions, are herewith incorporated in this Ordinance. Section 2. Hillman's Auburndale recorded in Volume 13, page King County, WA. section 2. The youth who live here shall not be allowed to have cars that are parked at the site or in the neighborhood. Auburn Youth Resources shall be responsible for monitoring this requirement. section 3. Auburn Youth Resources shall establish "house" rules for the conduct of the home. The Planning Director shall review those portions of the rules that may impact the adjoining properties. section 4. The residents of the house will be at least 18 years of age and not older than 22 years of age. section 5. Upon the passage, approval and publication of this Ordinance as provided by law, the City ClerIc of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. Section 6. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. section 7. This ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
