AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON ADDING A NEW
CHAPTER 3.14 TO THE AUBURN CITY CODE ENTITLED "CONTRACTS FOR
ARCHITECTURAL AND ENGINEERING SERVICES".
WHEREAS, the City of Auburn desires to add a new Chapter
3.14 to the Auburn City Code relating to public contracts;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. PURPOSE. The purpose of this ordinance is to
add a new Chapter 3.14 to the Auburn City Code entitled
"Contracts for Architectural and Engineering Services" in
accordance with Chapter 39.80 RCW.
Section Z. NEW SECTION TO TITLE 3. There is herewith
added to Title 3 of the City Code entitled "Revenue and
Finance" a new Chapter 3.14 entitled "Contracts for
Architectural and Engineering Services" as set forth in
Exhibit "A" attached hereto and incorporated herein.
Section 3. SEVERABILITY. Should any section,
subsection, paragraph, sentence, clause or phrase of this
ordinance be declared unconstitutional or invalid for any
reason, such decision shall not affect the validity of the
remaining portions of this ordinance.
Section 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directives of this legislation.

Section 5. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication, as provided by law.

3.14.010 Legislative declaration.
In accordance with Chapter 39.80 RCW, the City hereby
establishes a policy, to the extent provided in this chapter,
to publicly announce requirements for architectural and
engineering services, and to negotiate contracts for
architectural and engineering services on the basis of
demonstrated competence and qualification for the type of
professional services required and at fair and reasonable
prices.

3.14.020 Definitions.
Unless the context clearly requires otherwise, the
definitions in this section shall apply throughout this
chapter.
(A) "Architectural and engineering services" or
"professional services" means professional services
rendered by any person, other than as an employee of
the City, contracting to perform activities within
the scope of the general definition of professional
practice for professional engineers, land surveyor,
architects, and landscape architects as defined in
chapters 18.08, 18.43, or 18.96 RCW.
(B) "Person" means any individual, organization, group,
association, partnership, firm, joint venture,
corporation, or any combination thereof.
(C) "Consultant" means any person providing professional
services to the City who is not an employee of the
City.
(D) "Application,, means a completed statement of
qualifications together with a request to be
considered for the award of one or more contracts
for professional services.

3.14.030 Requirement for professional services--Advance
publication.
The City shall publish in advance requirements for
professional services. The announcement shall state concisely
the general scope and nature of the project or work for which
the services are required and a representative of the City who
can provide further details. The City shall: (1) Publish an
announcement on each occasion when professional services
provided by a consultant are required by the agency; or (2)
Announce annually to the public its projected requirements for
any category or type of professional services.
3.14.040 Procurement of architectural and engineering
services--Submission of statement of qualifications
and performance data--Participation by minority and
women-owned firms.
In the procurement of architectural and engineering
services, the City shall encourage firms engaged in the lawful
practice of their profession to submit annually a statement of
qualification and performance data.
The City shall evaluate current statements of
qualifications and performance data on file, together with
those that may be submitted by other firms regarding the
proposed project, and shall conduct discussions with one or

more firms regarding anticipated concepts and the relative
utility of alternative methods of approach for furnishing the
required services and then shall select therefrom, based upon
criteria established by the City, the firm deemed to be the
most highly qualified to provide the services required for the
proposed project.
Procedures and guidelines shall include a plan to insure
that minority and women-owned firms are afforded the maximum
practicable opportunity to compete for and obtain contracts
for services. The level of participation by minority and
women-owned firms shall be consistent with their general
availability within the professional communities involved.
3.14.050 Procurement of architectural and engineering
services--Contract negotiations.
The City shall negotiate a contract with the most
qualified firm for architectural and engineering services at a
price which the City determines is fair and reasonable. In
making its determination, the City shall take into account the
estimated value of the services to be rendered as well as the
scope, complexity, and professional nature thereof.
If the City is unable to negotiate a satisfactory
contract with the firm selected at a price the City determines
to be fair and reasonable, negotiations with that firm shall

be formally terminated and the City shall select other firms
in accordance with ACC 3.14.040 and continue in accordance
with this section until an agreement is reached or the process
is terminated.
3.14.060 Procurement of architectural and engineering
services--Exception for emergency work.
This chapter need not be compiled with when the City
makes a finding in accordance with this or any other
applicable law that an emergency requires the immediate
execution of the work involved. Nothing in this chapter shall
relieve the City from complying with applicable law limiting
emergency expenditures.
