AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
DEDICATION OF A PRIVATE STREET PROPOSED TO SERVE SHORT PLAT
NO. SPLOOOl-92, WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application No. MIS0007-92 dated June 1, 1992,
together with site plans therefore, has been submitted to the
City of Auburn, Washington, by WES UHLMAN requiring a street
dedication of the private street proposed to service Short
Plat No. SPLOOOl-92 located on the east side of "B" Street
N.W. in the 4200 block on property zoned M-1 (Light
Industrial) within the city of Auburn, Washington, hereinafter
described in Section 2 of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn city Hall, on August 18, 1992, at the
conclusion of which the Hearing Examiner recommended the
dedication of the private street proposed to serve Short Plat
Application No. SPLOOOl-92 located on the east side of "B"
Street N.W. in the 4200 block, in a M-1 (Light Industrial)
zone based upon the following Findings of Fact and
Conclusions, to-wit:

The applicant, Wes Uhlman, through his agent,
Sadler/Bernard and Associates, Inc., seeks a modification
to the Short Subdivision standards which would permit a
private street to exceed 600 feet in length. In
addition, the applicant and the city requests in
Application No. MIS0007-92 that access to the short plat
be dedicated to the City.
The subject property is located on the east side of "B"
Street N.W. in the 4200 block. The property is zoned M-
1, light industrial, and is currently vacant. The
property is designated for light industrial uses in the
Comprehensive Plan.
Surrounding zoning and land uses in the vicinity include
M-1 in all directions. Land to the north and south is
currently utilized for industrial purposes while land to
the east and west remains vacant. The Comprehensive Plan
designates land in all directions for light industrial
uses.

The applicant is requeKing modification to the Short
subdivision standards whiCh would permit a private street
to be 937.2 feet in length when the maximum length
permitted outright under the code is 600 feet. (See Land
Division Ordinance section 17.14.100(e) (8»

To the north of the proposed short plat is a 4-lot short
plat, SP-6-86. This plat was approved in 1988 and access
to this subdivision is provided by a 30-foot wide
easement on the south side of the adjoining plat.
Accordingly, the access easement for the subject plat and
the 30-foot wide access easement to short plat SP-6-86
abut one another.
There is an undeveloped parcel of the property which is
zoned M-1 located directly to the east of the proposed
short plat. This parcel received Preliminary Plat
approval for a 12-lot subdivision on July 20, 1992. The

Preliminary Plat illustrated a 60-foot wide street which
would connect to the two 30-foot wide easements of the
aforementioned plats. As a result of this proposed
connection, there would be a desirable through connection
between Auburn Way North and "B" street. It is quite
uncertain when the Preliminary Plat and its streets will
be developed. Accordingly, appropriate provisions must
be made for a turn-around and emergency vehicle access to
the proposed Short Plat until the through connection is
made.
9. The Land Division Ordinance permits a private street
within a Short Plat to be dedicated if the Planning
Director finds that the easement would provide for
desirable through connection between two public streets
pursuant to Section 17.14.100(f) (1) (b) of the Land
Division Ordinance.
10. The Planning Director has concluded the proposed easement
would be a desirable through connection and accordingly
dedication should be required.
11. In the area there are two streets providing for an
east/west connection route between Auburn Way North and
"B" Street. One of these streets, 37th Street, is 1700
feet to the south. The other street is 277th Street
which is 3300 feet to the north. This through connection
would result in a convenient east/west connector route.
12 . As a result of other previously approved developments,
there is not another opportunity to provide for a through
street except by going through the subject Short Plat.
13. The staff report, with its recommendation of conditional
approval is incorporated herein by reference as though
set forth in full.
COIlCLUSIOIlS 01' LAW
1. The private access proposed for the Short Plat should be
dedicated to the city.
2. Dedication of the street will provide an opportunity for
a through street between Auburn Way North and "B" Street
N.W.

For each of the
above referenced
reasons,
the
recommendation of the Hearing Examiner to the Auburn city
Council on this request for a street dedication of the private
street proposed to serve Short Plat No. SPLOOOl-92 is approved
and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1.
The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.
Section 2. The dedication of the private street proposed
to serve Short Plat Application No. SPLOOOl-92 is hereby
approved on property located on the east side of "B" Street
N.W. in the 4200 block in a M-1 (Light Industrial) zone,
situate in the city of Auburn, County of King, State of
Washington, and is legally described as follows:
Tract 16, White River Valley Home Tracts
according to the Plat thereof recorded in
Volume 13 of Plats, at page 17, records of
King County, Washington; LESS the west
15.00 feet for road.
Section 3. The 30-foot wide easement as illustrated on
the short plat be dedicated to the City.
This shall also
include a 35-foot radius at the intersection of this street
and "B" Street N.W.

Section 4. The 30-foot wide right-of-way shall be paved
a minimum width of 24-feet for its entire length. The
specific construction standards and its interface with the
private street to the north shall be approved by the city
Engineer.
Section 5. The applicant shall enter into an agreement
with the City that would defer the remainder of the
improvements to the 30-foot right-of-way that are typically
required of a pUblic street of this type.

pursuant to Section 4, prior to final approval of the short
plat.
Section 7. Upon the passage, approval and publication of
this Ordinance as provided by law, the city Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
Section 8. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 9.
This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
