AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW THE USE OF A DRIVE-UP WINDOW
FOR A RESTAURANT ON PROPERTY ZONED C-1 (LIGHT COMMERCIAL),
LOCATED IN THE 1400 BLOCK OF HARVEY ROAD, WITHIN THE CITY OF
AUBURN, WASHINGTON.
WHEREAS, Application No. CUP0005-92 dated July 14, 1992,
together with site plans therefore, has been SUbMlitted to the
city of Auburn, Washington, by ANDY HANDER requesting a
Conditional Use Permit to allow the use of a drive-up window
for a restaurant on property zoned C-1 (Light Commercial)
within the City of Auburn, Washington, hereinaft.er described
in Section 2 of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a pUblic hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on August 18, 1992, at the
conclusion of which the Hearing Examiner recc)mmended the
approval of the issuance of a Conditional Use Permit to allow
the use of a drive-up window for a restaurant to be located in
the 1400 block of Harvey Road, in an C-1 (Light Commercial)
zone based upon the following Findings of Fact and
Conclusions, to-wit:

1.
The applicant, Andy Hander, through his a~Jent, Hugh C.
Leiper, request a Conditional Use Permit to allow the use
of a drive-up window for a small restaurant.
The subject property is located in the 1400 block of
Harvey Road and is zoned C-1, light commercial. The
property is currently vacant and the site is designated
for general commercial uses in the Comprehensive Plan.

The applicant is proposing a very small, 320 square foot,
drive-in restaurant. The proposal calls for no interior
seating and all customers who use the restaurant will
utilize the drive-in facility only.

Surrounding zoning and land uses in the vicinity include
C-3, single-family, to the north; C-1, commercial, to the
south; C-1, vacant, to the east; and C-1, Commercial, to
the west. The Comprehensive Plan suggests general
commercial uses for properties to the sout.h, east, and
west, and heavy commercial uses for properties to the
north.

The subject property's zoning, C-1, light commercial,
only allows drive-in facilities if a Conditional Use
Permit is issued. Generally, the C-1 zone i:s intended to
be pedestrian oriented and accordingly the review
associated with a Conditional Use Permit alJLows the city
to determine the appropriateness of a drivEl-in facility
and see that it is sited properly.
The streets which adjoin the property, Harvey Road and
"I" street N.E., are major arterials. The subject parcel
was created when the City extended "I" Stree1: through the
property.
Access to the parcel is suppose to be provided from 14th
street and there will be no direct access from either of
the adjoining arterials.
The applicant proposes a 1500 square foot building in
addition to the 320 square foot drive-thru restaurant
facility.
The staff report, with its recommendation of approval, is
incorporated herein by reference as though set forth in
full.

CONCLUSIONS OF LAW
1. The zoning ordinance sets forth a series of criteria
which must be established before a Conditional Use Permit
can be granted. The first of these criterÌi:i is that the
use will have no more of an adverse effect on the health,
safety or comfort of persons living or wo>rking in the
area. Since the subject use is not only relatively
small, it appears that it will not generat,a significant
traffic. Also, the site plan appears to indicate there
is adequate ingress and egress and the layout and
proposed design alleviate any potential adverse impacts
to vehicular and pedestrian traffic in the area.
2. The proposal is consistent with the goals, policies and
objectives with the Comprehensive Plan.
3. The site plan and application appear to cODlply with the
zoning ordinance.
4. The proposal is consistent with the general character of
the vicinity.
5. There is no evidence which suggests that. the public
infrastructure will be affected by the propol;al.
For each
of
the
above referenced
reasons,
the
recommendation of the Hearing Examiner to the Auburn City
Council on this Conditional Use Permit to allow the use of a
drive-up window for a restaurant to be located in the 1400
block of Harvey Road, is approved.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Seotion 1. The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this

Seotion 2. A Conditional Use Permit is hereby approved

to 'allow the use of a drive-up window for a restaurant to be

located in the 1400 block of Harvey Road, in éln C-1 (Light

Commercial) zone, situate in the City of Auburn, County of

King, state of Washington, and is legally described on
10
attached Exhibit "A".

Seotion 3. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Cler]( of the City

of Auburn shall cause this Ordinance to be rec:orded in the
14
office of the King County Auditor.
Seotion 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Seotion S.
This Ordinance shall take effe>ct and be in
19 force five days from and after its passage, approval and
20 pUblication as provided by law.
