AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING
AUBURN CITY CODE CHAPTER 5.82 ENTITLED "TELEPHONE BUSINESS",
SPECIFICALLY AUBURN CITY CODE SECTION 5.82.020 ENTITLED
"COMPETITIVE TELEPHONE SERVICE DEFINED", TO COMPLY WITH
CHAPTER 80.36 RCW ENTITLED "TELECOMMUNICATIONS".

WHEREAS, in 1981 pursuant to Ordinance No. 3679, the City
of Auburn adopted Auburn City Code Section 5.82.020 entitled
"Competitive telephone service defined" to be in compliance
with RCW 80.36 entitled "Telecommunications"; and
WHEREAS, pursuant to an amendment by the Washington State
legislature to RCW 80.36, the City of AUburn now needs to

amend Auburn city Code Section 5.82.020 to be in compliance

therewith.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. PURPOSE. The purpose of this Ordinance is to
amend Auburn City Code Chapter 5.82 entitled "Telephone
18 Business", specifically Auburn City Code section 5.82.020
entitled "Competitive telephone service defined", to bring
20 Auburn City Code 5.82.020 into compliance with RCW 80.36

entitled "Telecommunications".
Section 2.
Section 5.82.020 of the Auburn City Code
23 entitled "Competitive telephone service defined" is hereby
24 amended as set forth in Exhibit "A" which is attached hereto
25 and incorporated herein.

Section 3. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.

EXHIBIT "A"
5.82.020 Competitive telephone service defined.

"Competitive telephone service" means the providing by

any person of telephone equipment, apparatus, or service,
6
related to that eauipment or apparatus. such as repair or
7
maintenance services. if the eauipment or apparatus « e~fter
~ftðn-~e~~-~er¥~~-~~» is of a type which can be provided
8
9
by persons that are not subject to regulation as telephone
companies under Title 80 RCW and for which a separate charge
is made.
